An Act to grant an Endowment to the Timaru Harbour Board.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title
The Short Title of this Act shall be The Timaru Harbour Board Endowment Act 1878.
2 Construction
In this Act the expression the Board means the Timaru Harbour Board, incorporated under The Timaru Harbour Board Act 1876 [Repealed].
3 Land to be vested in Board
Upon the coming into operation of this Act, the land described in the Schedule hereto shall, without any conveyance or assurance, vest in the Board for an estate in fee-simple.
4 Land may be taken for public works
Within six months after the passing of this Act it shall be lawful for the Minister of Public Works to take, without payment or compensation, out of the lands comprised in the Schedule, so much and such parts of the said lands as he shall consider necessary to be taken for Government works, as provided by Part 2 of The Public Works Act 1876.
Schedule
ALL that area in the Provincial District of Canterbury, in the Colony of New Zealand, situated on the beach at Timaru, being part of Reserve No 384, and containing by admeasurement one (1) acre one (1) rood thirty-three (33) perches, more or less. Commencing at a point on low-water mark on the eastern boundary of the said reserve, the said point being in line with the northern boundary of Section No 1, Rhodes Township; thence westerly, following a straight line to the north-eastern corner of the aforesaid section to high-water mark, a distance of one hundred and forty-five (145) feet or thereabouts, to north side of road to goods shed; thence south-westerly in a curved line along the said road to the south-eastern corner of Section No 27, in the township before mentioned; thence northerly, following the foot of the original cliff and cutting, to a point distant two (2) chains north of the engine-house; thence easterly, following a straight line parallel to the first-described boundary of this piece of land to low-water mark, and from thence returning along the same to the commencing point: be all the aforesaid distances more or less; as the same is delineated on the plan deposited in the Survey Office, Timaru.
All that area in the Provincial District of Canterbury, in the Colony of New Zealand, situated at Timaru, containing by admeasurement one (1) rood, more or less. Bounded on the West by Lecren's Terrace, one hundred (100) links; on the North by Lot 110, two hundred and twenty-two (222) links; on the East by Railway Reserve, one hundred (100) links; and on the South by Lot 108, two hundred and twenty (220) links: be all the aforesaid linkages more or less; as the same is delineated on the plan deposited in the Survey Office, Timaru.
