An Act to vest in the Newmarket District Board Control and Management of certain Land situated within the said District.
Preamble.
WHEREAS by grant bearing date the nineteenth day of May, one thousand eight hundred and seventy-five, the land described in the Schedule to this Act was granted to the Superintendent of the Province of Auckland as a Reformatory Reserve: And whereas the said land is not suitable for the site of a reformatory; and it is deemed expedient to discharge the same from such trust and purpose, and to vest the control and management of the same in the local governing body for the time being of the Newmarket District for other public uses:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act shall be “The Newmarket Reserve Act, 1878.”
2 Control and management of land vested in Newmarket District Board for recreation purposes.
The land described in the Schedule to this Act shall be and the same is hereby discharged from all trusts heretofore attached thereto, and is hereby set aside as a public recreation-ground for the use of the inhabitants in the vicinity thereof. The Newmarket District Board for the time being in office shall have the control and management of the aforesaid recreation-ground, and for such purpose shall have all such powers as shall be delegated to the said Board by the Governor under “The Public Domains Act, 1860.”
Schedule
All that parcel of land in the Provincial District of Auckland, in the Colony of New Zealand, containing by admeasurement three (3) acres and two (2) roods, more or less, situated in the Parish of Waitemata, in the County of Eden, and being Allotments numbers thirty-two (32) and thirty-three (33) of Section number four (4) of the Suburbs of Auckland. Bounded towards the North by a road, sixty-seven (67) links; towards the East by a road, one thousand three hundred and forty-six (1346) links; towards the South by a road, one hundred and three (103) links; towards the Southwest by a road, seven hundred and forty-five (745) links; and towards the North-west by a road, seven hundred and sixty-seven (767) links,
