An Act to validate certain Grants commonly known as the Whakatane Grants.
Preamble.
WHEREAS by “The Confiscated Lands Act, 1867,”
it is, among other things, enacted that it shall be lawful for the Governor from time to time, as he shall think fit, by Proclamation in the New Zealand Gazette, to reserve out of lands taken under the Acts therein referred to as “the said Acts,”
or out of lands which by “The East Coast Land Titles Investigation Act, 1866,”
and “The East Coast Land Titles Investigation Act Amendment Act, 1867,”
it is provided shall be deemed to be Crown lands, such lands as to him shall seem fit: And whereas the several parcels of land described in the Schedule hereto are lands taken under “The New Zealand Settlements Act, 1863:”
And whereas by “The Volunteers and Others Lands Act, 1877,”
it is, amongst other things, enacted that the provisions of “The Confiscated Lands Act, 1867,”
shall continue in operation, and shall be deemed to have been always in operation in respect of any reserves promised to Natives or set apart for Natives under the said Act at any time previous to the coming into operation of “The Waste Lands Administration Act, 1876,”
but which, for want of surveys or other unavoidable causes, could not be proclaimed previous to the time last mentioned: And whereas the lands described in the first column of the Schedule hereto were previous to the coming into operation of “The Waste Lands Administration Act, 1876,”
promised to Natives, but for want of surveys could not be proclaimed previous to that Act coming into operation: And whereas by a Proclamation dated the thirtieth day of January, one thousand eight hundred and seventy-eight, the Governor, in pursuance and exercise of the powers and authorities vested in him by the said recited Acts, did thereby proclaim and declare that the said several parcels of land should be and the same were thereby reserved for the purposes mentioned in the fourth section of the hereinbefore in part recited “Confiscated Lands Act, 1867:”
And whereas Crown grants of the pieces of land described in the said first column of the Schedule hereto were, on the respective dates mentioned in the second column of such Schedule, issued to the several persons whose names are set forth in the third column of such Schedule as trustees, upon the trusts and subject to the limitations and restrictions set forth in the fourth column of such Schedule: And whereas doubts have arisen as to whether such grants are valid, and such as are authorized to be issued under the authority of the said “Confiscated Lands Act, 1867,”
and it is expedient to validate the same:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act shall be “The Whakatane Grants Validation Act, 1878.”
2 Grants in whom vested.
The several grants hereinbefore mentioned shall be and the same are hereby validated, and shall be and be deemed to have vested the several pieces of land therein respectively specified in the several grantees as joint tenants in fee-simple to hold upon the trusts, with the powers, and subject to the restrictions and limitations, set forth therein respectively.
3 Grants to be registered.
The land comprised in the said several Crown grants shall be deemed to be land contracted to be alienated by the Crown in fee prior to the day on which such land was included in the Land Registrar’s District under “The Land Transfer Act, 1870,”
and such grants shall be registered in the Register Office of the registration district, under “The Deeds Registration Act, 1868,”
within which the granted land is situated.
4 Date when legal estate vested in grantees may be indorsed.
It shall be lawful for the Minister of Lands to indorse on any such grant a memorandum under his hand that the legal estate in the granted land shall be deemed to have been in the grantees on and from such date as the Minister of Lands may deem advisable, and such memorandum shall have the same effect as the insertion of the antevesting date in the habendum of a grant under “The Crown Grants Act, 1866.”
