An Act to provide for Highway Board Elections in the Provincial District of Wellington.
Preamble.
WHEREAS under “The Rating Act, 1876,”
it was provided that all valuation rolls should be based upon the annual value of property: And whereas under “The Highways Act, 1874,”
of the Province of Wellington, the voting power of ratepayers for Highway Hoards within the Provincial District of Wellington is regulated by the value for sale of property: And whereas it is expedient to make other provision for regulating the voting at any such election, so that the same shall conform with the provisions of “The Counties Act, 1876:”
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Wellington Provincial District Highway Boards Act, 1879.”
2 Election of Highway Boards.
Every ratepayer within the limits of any highway district within the Provincial District of Wellington shall be entitled to vote at every election of a member of a Highway Board for the ward in which he is enrolled, according to the following scale, that is to say,—
(1.)
If lais rateable property, whether in one or more tenements, is valued on the valuation-roll at less than fifty pounds, he shall have one vote;
(2.)
If such property is valued at not less than fifty pounds but less than one hundred pounds, he shall have two votes;
(3.)
If such property is valued at not less than one hundred pounds but less than one hundred and fifty pounds, he shall have three votes;
(4.)
If such property is valued at not less than one hundred and fifty pounds but less than three hundred and fifty pounds, he shall have four votes;
(5.)
If such property is valued at three hundred and fifty pounds and upwards, he shall have five votes.
3 Persons rated under “Rating Act, 1876,”
or amending Acts, entitled to vote at election of Warden for ward in which rated.
Every person rated under “The Rating Act, 1876,”
or any Act amending the same, shall be entitled to vote at the election of a Warden for the ward in which he is rated.
4 Provision when necessary act has been omitted to be done.
Whenever under “The Highways Act, 1874,”
aforesaid, or under another Act of the Province of Wellington intituled “The Local Boards Act, 1873,”
any appointment or other necessary act, matter, or thing requiring to be made or done has not been made or done before the expiration of the time or of the power for doing the same, the Governor may make any such appointment, or do any such act, matter, or thing, respectively, in the stead of the persons who ought to have made or done the same.
