An Act to amend “The Oamaru Harbour Board Ordinance Amendment Act, 1878.”

Preamble.

WHEREAS it is expedient to permit the Oamaru Harbour Board (hereinafter called “the Board”) to exercise without delay their present borrowing powers:

Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title.

The Short Title of this Act is “The Oamaru Harbour Board Act, 1879.”

2 Borrowing powers of Board.

Notwithstanding anything to the contrary contained in “The Oamaru Harbour Board Ordinance Amendment Act, 1878,” it shall be lawful for the Board forthwith to raise the full amount authorized to be borrowed by the said Act: Provided that nothing in this Act, or in “The Oamaru Harbour Board Ordinance Amendment Act, 1878,” shall have the effect of interfering with the priority of claims of any debentures already issued.

3 Receiver may be appointed.

In case default shall be made in payment of the moneys borrowed under the authority of this Act, or of “The Oamaru Harbour Board Ordinance Amendment Act, 1878,” or any instalment thereof, or of the interest which may become payable in respect thereof, for the space of six calendar months after the same shall become due, it shall be lawful for the Supreme Court, on the application of the holders of sureties to the amount of not less than one thousand pounds, to appoint a Receiver of all rates and moneys upon which the same shall be secured.
