An Act to vest in the Chairman, Councillors, and Inhabitants of the Southland County the Oreti Bridge and Tolls, and the Ferry Reserves.
Preamble.
WHEREAS a bridge was some time since erected over the River Oreti, in the Provincial District of Southland, which said bridge and the tolls chargeable for the use of the same, together with the lands described in the Schedule hereto, are now vested in one Walter Henry Pearson, for the residue of two several terms of twenty-one years respectively, computed from the twenty-fourth day of October, one thousand eight hundred and sixty-seven, and created by two several deeds of lease, the one dated the twenty-seventh day of February, one thousand eight hundred and sixty-eight, and made between John Parkin Taylor, then Superintendent of the Province of Southland, of the first part, Charles Dopping Irvine of the second part, and Alexander Jerusalem Smyth of the third part, whereby the said bridge and tolls, and part of the said land, were demised; and the other, dated the twenty-seventh day of August, one thousand eight hundred and sixty-nine, and made between the said John Parkin Taylor, as such Superintendent as aforesaid, of the first part, the said Charles Dopping Irvine of the second part, the said Alexander Jerusalem Smyth of the third part, and the said Walter Henry Pearson of the fourth part, whereby the residue of the said land was demised; which said several terms are still subsisting: And whereas it is expedient that the said bridge and the tolls payable for the use of the same and the said lands respectively should be vested in “The Chairman, Councillors, and Inhabitants of the Southland County,”
with the powers hereinafter mentioned, but subject to the said several deeds of lease:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Oreti Bridge and Ferry Reserves Act, 1879.”
2 Oreti Bridge, tolls, and reserves to be vested in Southland County Council, subject to leases.
The Oreti Bridge and the tolls payable for the use of the same and the land described in the Schedule hereto respectively shall, from and after the passing of this Act, be and become vested in “The Chairman, Councillors, and Inhabitants of the Southland County,”
as part of the property of the said corporate body, subject to the said recited leases.
3 Council may purchase interest of lessee, and sell reserves for payment of price.
The County Council of the said county may contract with the lessee of the said bridge, tolls, and land respectively, for the purchase of his term, estate, and interest therein respectively, by virtue of the said several deeds of lease, for such price in money as shall be agreed upon between them, and may, for the purpose of raising the money necessary for the payment of such price, sell all or any part of the said land described in the Schedule hereto, and may make such sale either in one or more lot or lots and by public auction or by private contract, and upon such terms and conditions in all respects as the said Council shall think fit, and may convey the land sold under the authority aforesaid to the purchaser or purchasers thereof, and may apply the moneys to be received upon such sale, or a competent part thereof, as the case may require, in the first place in payment of the expenses attending such sale, and in the next place in payment of the price payable to the lessee aforesaid in respect of his said term, estate, and interest in the said bridge, tolls, and land respectively, and the balance, if any, of such moneys, shall form part of the County Fund: Provided always that, before entering into any such contract with the said lessee, the assent thereto of the ratepayers of the said county shall be ascertained in like manner, mutatis mutandis, as is provided by sections one hundred and forty to one hundred and forty-six, inclusive, of “The Counties Act, 1876,”
for ascertaining the assent of ratepayers to special loans.
4 After purchase bridge to be free of tolls.
From and after the purchase from the lessee aforesaid by virtue of this Act of his term, estate, and interest in the said bridge, tolls, and land respectively, no tolls shall be charged for the use of the said bridge, and the same shall and may thereafter be used by all persons without being liable for any toll or charge for such user, subject nevertheless to such by-laws as may from time to time be in force for regulating the use of the same.
Schedule
All that piece or parcel of land situate in the said Provincial District of Southland, containing by admeasurement fifty-four acres two roods and one perch, more or less, being part of that parcel of land marked “Ferry Reserve”
in Block sixteen on the Crown grant record map of the Invercargill Hundred. Bounded towards the North-east by Section eight, same block, one thousand four hundred and thirty-six links or thereabouts, and Section seven of aforesaid block, three thousand and fifty links: towards the South by a public road, two thousand five hundred and ninety links or thereabouts; and towards the West and North-west by the road reserve one hundred links wide along the bank of the Oreti River.
Also all that piece or parcel of land situate in the said Provincial District of Southland, containing by admeasurement thirty-five acres two roods and one perch, more or less, being part of that parcel of land marked “Ferry Reserve”
in Block sixteen on the Crown grant record map of the Invercargill Hundred aforesaid. Bounded towards the North by a public road, two thousand five hundred and forty links or thereabouts; towards the East by Section thirty-two of aforesaid block, three thousand five hundred and fifty links and one thousand tour hundred and fifty links; and towards the South, West, and South-west by a road reserve one hundred links wide along the bank of the Oreti River.
Also all that piece or parcel of land situate in the said Provincial District of Southland, containing by admeasurement forty-five acres and three roods, more or less, being part of that parcel of land marked “Ferry Reserve”
in Block fifteen on the Crown grant record map of New River Hundred. Bounded towards the North by part of north boundary of Block fifteen aforesaid, two thousand two hundred and twenty links or thereabouts; towards the South-east and East by the road reserve one hundred links wide along the bank of the Oreti River; towards the South by a public road, one thousand six hundred and ten links or thereabouts; and towards the West by Crown land, two thousand five hundred links.
Also all that piece or parcel of land situate in the said Provincial District of Southland, containing by admeasurement two hundred and fourteen acres, being part of that parcel of land marked “Ferry Reserve”
in Block fifteen on the Crown grant record map aforesaid. Bounded towards the North by a public road, three thousand five hundred and thirty links or. thereabouts; towards the North-east and East by the road reserve one hundred links wide along the bank of Oreti River; towards the South-west by a public road, seven thousand five hundred and fifty links or thereabouts; and towards the West by a public road, two thousand five hundred and thirty links. As the said several parcels of land are delineated on the maps deposited in the Survey Office, Invercargill.
