An Act to vest the Auckland Provincial Council Library and the Auckland Mechanics’ Institute in the Mayor, Councillors, and Citizens of the City of Auckland.
Preamble.
WHEREAS the ratepayers of the City of Auckland, at a poll taken on the nineteenth day of June, one thousand eight hundred and seventy-nine, under “The Public Libraries Act, 1869,”
did determine to adopt that Act, and notice of such adoption has been given in accordance with the provisions of the said Act: And whereas it is desirable to aid the establishment of a free public library in the City of Auckland by handing over to the Mayor, Councillors, and Citizens of the City of Auckland, hereinafter called “the said Corporation,”
the library known as the Auckland Provincial Council Library, and at present deposited in the Auckland Institute: And whereas the Auckland City Council has agreed with the committee of management of the Auckland Mechanics’ Institute to take over the real and personal estate of the said Mechanics’ Institute, to be held as part of the property of the library to be established under the said Act:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Auckland Free Public library Aid Act, 1879.”
2 Provincial Council library to be given to the City of Auckland.
It shall be lawful for the Governor, upon the passing of this Act, to hand over to the said Corporation the whole of the library known as the Auckland Provincial Council Library, to be by them maintained, extended, and managed as part of the library to be established in the City of Auckland, pursuant to the provisions of “The Public Libraries Act, 1869,”
and the Acts amending or extending the same.
3 “Public Libraries Subsidies Act, 1877,”
not affected hereby.
Nothing in this Act contained shall be construed as altering or affecting the provisions of section three of “The Public Libraries Subsidies Act, 1877.”
4 Mechanics’ Institute to be transferred to City of Auckland.
It shall be lawful for the committee of management of the Auckland Mechanics’ Institute, in pursuance of the agreement entered into with the Auckland City Council, to hand over all property, real and personal, belonging to the said Mechanics’ Institute to the said Corporation, to be held by the said Corporation for and on behalf of and as part of the property belonging to the said free public library so to be established in the City of Auckland aforesaid.
5 New grant to be made to borough.
It shall be lawful for the Governor, upon the Mechanics’ Institute being handed over to the said City Council, by writing under his hand, to revoke the existing grant to the Superintendent of Auckland of the site of the Mechanics’ Institute, as described in the Schedule hereto, and to make a fresh grant of the said site to the said Corporation.
6 Mechanics’ Institute may be sold, and proceeds expended on public library.
It shall be lawful for the said City Council, at any time hereafter, to sell the fee-simple of the said site by public auction, free and discharged of a lease thereof for nine hundred and ninety-nine years, made on the fifteenth day of August, one thousand eight hundred and forty-three, and of all trusts upon which the same is now held, and the proceeds of such sale shall be applied by the City Council towards purchasing a site for the said free public library, and erecting a building for such library within the City of Auckland.
7 Borough to pay liabilities and recover debts.
All liabilities of the committee of management of the said Mechanics’ Institute shall be defrayed by the said City Council; and all debts due to the said committee of management shall be payable to and recoverable by the said City Council, and may be sued for in the name of the Town Clerk of the said city.
Schedule
All that allotment or parcel of land containing by admeasurement one (1) rood and nine (9) perches, more or less, situated in the City of Auckland, being the western half of Allotment No. 26 of Section No. 4. Bounded on the North-west by Chancery Street, one hundred and sixty-four (164) links; on the North-east by Allotment No. 25, two hundred and thirteen (213) links; on the South-east by the remaining part of Allotment No. 26, one hundred and twenty-nine (129) links; and on the South-west by Allotment No. 27, two hundred and fifty-three (253) links: be all the aforesaid linkages more or less; as the same is delineated on the plan deposited in the Survey Office, Auckland.
