An Act to declare valid Rates made under “The Otago Roads Ordinance, 1871,”
although Road Districts have not been Proclaimed into Subdivisions.
BE IT ENACTED by the General Assembly of New, Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Otago Road Rates Validity Act, 1880.”
2 Rates made before passing of Act not invalid because district not proclaimed into subdivisions.
No rate made and levied by any District Road Board constituted under “The Otago Roads Ordinance, 1871,”
or any amendment thereof, prior to the passing of this Act, shall be deemed invalid by reason only that the road district was not at the time of the making of such rate proclaimed into subdivisions as by the forty-third section of the said Ordinance provided.
3 Recovery of rate made as aforesaid.
Every such rate imposed and made leviable after the first day of January, one thousand eight hundred and seventy-nine, may be recovered and payment thereof enforced in any Court of competent jurisdiction.
Non-subdivision of district no bar to such recovery.
No District Road Board or any person authorized or empowered to sue for or collect such rate under the said Ordinance shall be barred of any right or remedy in respect of such suit or recovery by reason only that it has been decided by any Court that such rate is not recoverable because the road district was not at or prior to the making of such rate proclaimed into subdivisions.
