Contents
An Act to authorize the Governor to cancel certain Grants from the Crown to the Wanganui Harbour and River Conservators Board, and to issue other Grants in lieu thereof, and to alter and extend the Boundaries and Area of a certain Piece of Land authorized to be granted, but not yet granted, to the said Wanganui Harbour and River Conservators Board.
Preamble.
WHEREAS by the fifty-third section of “The Wanganui Harbour and River Conservators Board Act, 1876”
(hereinafter referred to as “the said Act”
), it was enacted as follows, that is to say: “The Governor, with the advice and consent of the Executive Council of New Zealand, may, in the name and on behalf of Her Majesty, grant to the Board the several lots and parcels of land marked respectively with the letters A, B, C, D, E, F, G, H, J, K, and L on the plan, and thereon coloured pink, and respectively containing the acreage specified in the Schedule hereto:”
And whereas on the fifteenth day of May, one thousand eight hundred and seventy-eight, separate Crown grants were made and executed to the Wanganui Harbour and River Conservators Board (hereinafter referred to as “the Board”
) of the whole of the lots and parcels of land marked respectively with the letters D and F, and of parts of the lots and parcels of land marked respectively with the letters C and E, on the plan referred to and in the Schedule to the said Act: And whereas it is expedient to alter and extend the boundaries and area of the lands comprised in the said grants, and to alter and extend the boundaries and area of the lot and parcel of land marked with the letter G on the plan referred to and in the Schedule to the said Act:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Wanganui Harbour and River Conservators Board Grant Act, 1880.”
2 Interpretation of “plan.”
In the construction of the third and fourth sections of this Act the word “plan”
means the plan marked “P.W.D. 7880”
authenticated for the purposes of this Act by the signatures of the Speakers of the Legislative Council and House of Representatives respectively, and deposited in the office of the Minister for Public Works at Wellington.
3 Governor authorized to cancel grants and issue others in lieu thereof.
It shall be lawful for the Governor, in the name and on behalf of Her Majesty, to cause the said grants already issued as aforesaid to be cancelled, and in lieu thereof to issue new grants to the Board of the several lots and parcels of land marked respectively with the letters A and B on the plan, and thereon coloured pink, and respectively containing the acreage specified in the Schedule hereto; and in such grants the legal estate in the lands comprised therein shall be declared to have vested in the Board as from the fifteenth day of May, one thousand eight hundred and seventy-eight.
4 Further grant of land to Board.
The Governor, with the advice and consent of the Executive Council of New Zealand, may, in the name and on behalf of Her Majesty, grant to the Board the lot and parcel of land marked with the letter C on the plan, and thereon coloured purple, and containing the acreage specified in the Schedule hereto.
5 Saving clause.
Save as herein provided, nothing herein contained shall be deemed to alter or repeal the fifty-third section of the said Act.
Schedule
Lot A. Eight (8) acres and one (1) rood.
Lot B. Twelve (12) acres two (2) roods and thirty (30) perches.
Lot C. One (1) acre one (1) rood and eleven (11) perches.
