An Act to authorize the Sale of the North Timaru Cemetery Reserve.
Preamble.
WHEREAS the laud described in the Schedule hereto has been set apart as a public cemetery, and the care and management thereof have been vested in Trustees appointed in pursuance of “The Cemeteries Management Act, 1877:”
And whereas the said land is unsuitable as a place for the interment of the dead:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The North Timaru Cemetery Sale Act, 1882.”
2 Sale of North Timaru Cemetery Reserve authorized.
The Governor may, by notification in the Gazette, authorize the Land Board of the Canterbury Land District to sell in town lots the North Timaru Cemetery Reserve, hereinafter more particularly described in the Schedule to this Act, upon the terms and conditions set forth in “The Land Act, 1877,”
relating to the sale of town lands: Provided always that the requirements of section one hundred and fifty-three of the said “Land Act. 1877,”
shall be given effect to before any such sale takes place.
3 Application of proceeds.
The proceeds of the sale of the aforesaid cemetery shall be paid over by the Receiver of Land Revenue for the Land District of Canterbury to the Trustees appointed for the maintenance and care of the said cemetery under “The Cemeteries Management Act, 1877,”
who shall expend the same in or towards the purchase of another section of land, which must be conveyed and assured to Her Majesty in trust as a site for a public cemetery, to be dealt with under the provisions of “The Cemeteries Management Act, 1877,”
and any Act or Acts amending the same, or any Act or Acts of the Parliament of New Zealand for the time being relating to the care or management of cemeteries.
Schedule
All that parcel of land, in the Arowhenua Survey District, Provincial District of Canterbury, containing 5 acres, more or less. Bounded—Northward by Section No. 1701; Eastward by Section No. 965; and Southward and Westward by a road-line: and numbered 146 (in red) on the official map in the Survey Office, Christchurch.
