An Act to alter the Boundaries of the Peninsula Road. District and the Portobello Road District.
Preamble.
WHEREAS under and by virtue of “The Otago Roads Ordinance, 1871,”
there were constituted, inter alia, the road districts of the Peninsula and Portobello: And whereas it is expedient that the boundaries of the said road districts, and of their respective subdivisions, should be altered in manner hereinafter appearing:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Portobello Road Board Enabling Act, 1882.”
2 Boundaries altered.
The boundaries of the Peninsula Road District and of the Portobello Road District, and of their respective subdivisions, shall be altered in the manner mentioned in the Schedule hereto.
3 Accounts adjusted.
The accounts between the Peninsula Road Board and the Portobello Road Board aforesaid shall be adjusted, in consequence of the alteration of the said districts, by an auditor to be appointed by the Governor for that purpose, who shall determine in what proportion the liabilities of the old Board shall be paid by the new Board constituted by this Act; and shall also determine the amount, if any, that one Board shall pay to the other of them; and such determination shall be final and conclusive; and either Board may sue the other for the amount to be paid by the other; and any creditor of the old Board may sue the new Board, who shall, by the determination of the action, be ordered to pay the new credit.
4 Roads constituted main district roads.
The roads at present known as the Upper Road and the Beach Road shall, from the passing of this Act, both become main district roads.
5 New voters’ rolls to be formed.
This Act shall come into force on the first day of January, one thousand eight hundred and eighty-three, and immediately thereafter a new voters’ roll shall be prepared for each subdivision of the said districts as constituted under this Act and described in the Schedule hereto. Such voters’ rolls shall be made up from the voters’ rolls now in force for the subdivisions of the said districts, as described in the First Schedule to “The Otago Roads Ordinance, 1871.”
6 Extraordinary election to be held in February, 1883.
On the second Monday in February, one thousand eight hundred and eighty-three, the members of the Boards of the said districts then in office shall cease to hold office, and an election of members to fill their places shall be held on that day. Such election shall be in substitution of the annual election to be held under the said Ordinance for the year one thousand eight hundred and eighty-three, and the members elected at such election shall hold office until their successors are elected at the ordinary election to be held in the year one thousand eight hundred and eighty-four.
Schedule
Portobello Road District
Comprises all that area bounded towards the South-west and North-west by the Otago Harbour to the north-westernmost angle of the Native Reserve; towards the North-east by the said Native Reserve and the Papanui Inlet, and again by the said Native Reserve; towards the South-east by the ocean and Hooper’s Inlet, and by Sections 31 and 30, Block V., Portobello Bay Survey District; thence across a road and by Sections 2 of 64, 2 of 36, 1 of 36, 35, 34, 33, 45, 47, 49, and 2 of 51, to the Portobello Road; thence across and by that road, and by Sections 1 of 46, 2 of 46, 53, 52, across a road, and Section 71, all of Block II., Otago Peninsula Survey District, to the south-east corner of Section 73 of the same block; thence by a right line to the northeast corner of Section 70; thence by the said Section 71, and Sections 63, 65b, 66, 65a, said Sections 66 and 67, all of said Block II., Otago Peninsula Survey District; thence by said Section 67, a road-line, and by Sections 10, 9, 2 of 8, 1 of 8, 7, 6, 5, 1 of 3, and 1 of 2, Block I., Otago Peninsula Survey District; and thence by the boundary-line between Upper Harbour East Survey District, and the Otago Peninsula Survey District to the northernmost angle of Section 1, Block VIII., Anderson’s Bay Survey District; thence by said Section 1 to its westernmost angle; thence by a right line to the easternmost angle of Section 8, Block V., said district, and by said Section 8, and Sections 7, 6, 5, 4, 3, 2, 1, a closed road, and by north-western boundary-line of Section 12, Block V., Anderson’s Bay Survey District, produced to the Otago Harbour, the starting point. Also all that other piece of land bounded towards the West and North by Otago Harbour; towards the South-east by Section 11, Block III., Anderson’s Bay Survey District; towards the South-west by a road-line bounding Section 12 for about 10 chains; thence towards the South-east by a line bearing about south 30° west until it touches a road leading to Mr. Cutten’s house; thence by that road to the western boundary of the land occupied by Mr. Williams, in Section 72, Block VII., Town District; and thence by the western boundary-line of the land so occupied to Otago Harbour.
North-East Harbour Subdivision.
Comprises all that area bounded towards the South-west and North-west by Otago Harbour; towards the North by Section 13, Upper Harbour East Survey District, and Section 71, Block II., Otago Peninsula Survey District, to the Peninsula Road District, hereinafter described; towards the East, South, and South-east, by the Peninsula Road District, as hereinafter described, to the Otago Harbour. Also all that other piece of land bounded towards the West and North by Otago Harbour; towards the South-east by Section II, Block III., Anderson’s Bay Survey District; towards the South-west by a road-line bounding Section 12 for about 10 chains; thence towards the South-east by a line bearing about south 30° west until it touches a road leading to Mr. Cutten’s house; thence by that road to the western boundary of the land occupied by Mr. Williams, in Section 72, Block VII., Town District; and thence by the western boundary-line of the land so occupied to Otago Harbour.
Broad Bay Subdivision.
Comprises all that area bounded towards the West and North by the Otago Harbour; thence across a road to the north-western corner of Section 1, Block VI., Portobello Bay Survey District; towards the North-east by said Section 1, and Sections 2, 3, and 4, also of the same block, across a road to Section 29, Block V., said survey district; thence by said Section 29, and Sections 27, 25, 23, 21, 19, 17, 15, and 14, Block V., Portobello Bay Survey District, and across a road to Hooper’s Inlet; towards the East by Hooper’s Inlet; towards the South-east, South-west, and again towards the South-east by the Peninsula Road District, hereinafter described; and again towards the Southwest by the North-East Harbour Subdivision of the Portobello Road District, hereinbefore described, to the starting point.
Portobello Bay Subdivision.
Comprises all that area bounded towards the North-west by Otago Harbour; towards the North-east by the Native Reserve and Papanui Inlet, and again by the Native Reserve; towards the South-east by the ocean; and towards the South-west by Hooper’s Inlet and Broad Bay Subdivision of Portobello Road District, hereinbefore described.
Peninsula Road District
Comprises all that area bounded generally towards the North-west by the Otago Harbour and the Portobello Road District, hereinbefore described; towards the East by Hooper’s Inlet and the ocean; towards the South by the ocean; and towards the West by the western boundary-line of Section 78, Block VII., Town District, produced to the ocean, and by the Boroughs of St. Kilda and South Dunedin.
Anderson’s Bay Subdivision.
Comprises all that area bounded towards the North-west by the Otago Harbour and the Portobello Road District, hereinbefore described; towards the East by a right line from the south-east angle of Section 45, Upper Harbour East Survey District, to the northernmost angle of Section 41, Block III., Tomahawk Survey District; towards the South-east by the said Tomahawk Survey District to the westernmost angle of Section 27 said block and district, across a road to Section 22; thence by Sections 22, 21, 20, 19, 18, and 17, Block VIII., Anderson’s Bay Survey District, to the northernmost angle of last-mentioned section; thence by said. Section 17, across a road, and by Sections 13 and 23, Block VII., Anderson’s Bay Survey District, to the lagoon; thence by said lagoon and Block VII., Otago Peninsula Survey District, to the Borough of St. Kilda, and by that borough and the Borough of South Dunedin.
Highcliffe Subdivision.
Comprises all that area bounded towards the North-west by the Portobello Road District, hereinbefore described, to the north-western boundary of Section 1 of 46, Block II., Otago Peninsula Survey District; towards the North-east by said Section 1 of 46, and Sections 1 of 44, 42, 40, 39, across a road, other part of 39, 38, and 37, all of Block II., Otago Peninsula Survey District; towards the South and South-east and North-east respectively by Section 4, across a road, by other portion of Section 4, again across a road to the northernmost angle of Section 1 of 3; thence by said Section 1 of 3 and 2 of 3, and across a road-line to Section 52, all of Block III., Otago Peninsula Survey District; and thence by said Section 52 and across a road to the ocean; towards the South by the ocean; and towards the South-west and West by the Tomahawk Survey District and Anderson’s Bay Subdivision of Peninsula Road District, hereinbefore described.
Tomahawk Subdivision.
Comprises all that area bounded towards the North-west by Anderson’s Bay Subdivision of Peninsula Road District, as hereinbefore described; towards the North-east and South-east by the Highcliffe Subdivision of the Peninsula Road District as hereinbefore described; towards the South by the ocean; and towards the South-west by the western boundary-line of Section 78, Block VII., Town District, produced to the ocean, and by the Borough of St. Kilda.
Sandymount Subdivision.
Comprises all that area bounded towards the North-west and North-east by the Portobello Road District, hereinbefore described, to the south-east corner of Section 1, Block V., Portobello Bay Survey District; towards the East by Hooper’s Inlet and the ocean; towards the South-east by the ocean; and towards the South-west and North-west, and again towards the South-west, by the Highcliffe Subdivision of the Peninsula Road District, as hereinbefore described.
