Wellington Harbour Board Land and Reclamation Act 1883

An Act to vest certain Lands in the Wellington Harbour Board, and also to authorize the Reclamation by the said Board of such and certain other Lands in the Harbour of Wellington.

  • Preamble

    WHEREAS the lands described in Schedule 1 to this Act are already vested in the Wellington Harbour Board, and it is expedient that the lands described in the Second Schedul should be in like manner vested in the said Board, and that power should be given to the said Board to reclaim all the above-mentioned lands from the seas: And whereas it is also expedient to dedicate certain portions of the lands included in the First and Second Schedules hereto as and for a public street, the said portions being described in the Third Schedule hereto:

BE IT THEREFORE ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title

  • The Short Title of this Act is The Wellington Harbour Board Land and Reclamation Act 1883.

2 Interpretation

  • In the construction of this Act, if not inconsistent with the context, Board means the Wellington Harbour Board as constituted under The Wellington Harbour Board Act 1879.

3 Land in Schedule 2 vested in Board for purpose of widening approach to Queen's Wharf

  • The parcel of land described in Schedule 2 to this Act is, subject to the reservations and conditions hereinafter described, hereby vested in the Board for the purpose of widening the approach to the wharf in the Port of Wellington known as the Queen's Wharf.

4 Land in Schedule 3 reserved for a public street

  • Out of the parcels of land described in Schedules 1 and 2 hereto the parcel of land described in Schedule 3 hereto shall be and the same is hereby vested in the Mayor, Councillors, and citizens of the Borough of Wellington, and shall, when reclaimed from the sea by the Board or other lawful authority, be deemed to be dedicated to the public, and shall be used as and for a public street; and the Council of the borough shall, in respect of such street, have all such powers, duties, and liabilities as it has in respect of other public streets of the borough.

5 Land in Schedule 4 vested in Board as an endowment

  • The piece or parcel of land described in Schedule 4 is hereby vested in the Board as an endowment for the Board for the purposes for which it is constituted, and subject to the provisions of The Harbours Act 1878.

6 Board may reclaim land in Schedules

  • The Board may, subject to the provisions of The Harbours Act 1878, from time to time fill up and reclaim from the sea the land described in the several Schedules to this Act, or any part thereof respectively; and may for that purpose, if they think fit, enter into any contract or contracts with any person or persons for the execution of all or any works which may be necessary or expedient in or about the filling-up and reclamation of such land as aforesaid, upon such terms and conditions as may seem to them proper and reasonable.

7 Act to be deemed a special Act

  • This Act shall be deemed to be a special Act within the meaning of sections one hundred and forty-seven and one hundred and forty-eight of The Harbours Act 1878.

Schedule 1

ALL that piece of land covered by sea, situate within the Harbour of Port Nicholson, containing by admeasurement three (3) roods and thirty-seven (37) perches, more or less. Bounded towards the North-west by the Queen's Wharf, two hundred and eighty (280) links; towards the South-east by the Te Aro Foreshore grant of 1874 four hundred and fifty-one (451) links; towards the South-west by the production of the northern side of Hunter Street from Customhouse Quay to the said Te Aro foreshore grant, three hundred and one (301) links; again towards the North-west by Custom-house Quay, one hundred and fifty-one (151) links; again towards the North-east by the Queen's Bonded Store, sixty-nine and eight-tenths (69.8) links; and towards the North-west by the said Store, one hundred and fifty-two (152) links to the Queen's Wharf aforesaid, the same being shown on plan and coloured green. Be all the aforesaid linkages more or less.

Schedule 2

ALL that piece of land covered by sea, situate within the Harbour of Port Nicholson, containing by admeasurement one (1) rood and thirty-four (34) perches more or less, commencing at a point on the south-eastern side of the Queen's Wharf three hundred and fifty-five (355) links distant from the intersection of the said side produced by the south-eastern side of Customhouse Quay. Bounded towards the South-east by the land described in Schedule 1, two hundred and seventy (270) links and ten (10) links respectively; towards the South-west by the Queen's Bonded Store, sixty-nine (69) links; towards the North-west by Customhouse Quay, two hundred and nineteen (219) links; towards the North-east by a line drawn parallel to Hunter Street to the intersection of the north-western side of the Queen's Wharf by the production of the face-line of the reclamation now being carried out by the City Council, two hundred and fifty-seven (257) links; and towards the East by the production of the face-line of the said reclamation, eighty-three (83) links: the same being shown on plan and coloured yellow. Be all the aforesaid linkages more or less, As the said pieces of land are more particularly delineated upon the plan marked MD 819, deposited in the office of the Marine Department, Wellington.

Schedule 3

ALL that piece of land covered by sea situate within the Harbour of Port Nicholson, containing by admeasurement one (1) rood twenty-one (21) perches, commencing at a point on the south-eastern side of the Queen's Wharf distant three hundred and fifty-five (355) links from the intersection of the said side produced by the south-eastern side of Customhouse Quay. Bounded—South-easterly by a line, two hundred and eighty-six (286) links, portion of the south-eastern boundary of land described in Schedule 1; Westerly by a line, four hundred and fifteen (415) links, intersecting land described in Schedules 1 and 2; North-easterly by a line, one hundred and seventy-six (176) links, being portion of the north-eastern boundary of land described in Schedule 2; Easterly by a line to commencing point, eighty-three (83) links, being the eastern boundary of portion of land described in Schedule 2: the same being shown on plan and hatched red, referred to in Schedule 4. Be all the aforesaid linkages more or less.

Schedule 4

ALL that piece of land covered by sea situate in the Harbour of Port Nicholson, containing by admeasurement thirteen (13) perches, more or less, and coloured brown on the plan hereinafter referred to. Bounded towards the East by the production southward of the western boundary of the land described in Schedule 3 hereto, one hundred and ninety-two (192) links; towards the South-west by the production of the South-western boundary of the land described in Schedule 1 hereto, one hundred and two (102) links; and towards the North-west by the Te Aro Foreshore Grant of 1874, being part of the south-eastern boundary of the land comprised in Schedule 1, one hundred and sixty-five (165) links. Be all the aforesaid areas and linkages more or less.

As the said pieces of land are more particularly delineated on the plan marked MD 819, deposited in the office of the Marine Department, Wellington.
