An Act to empower the Boroughs of Caversham, South Dunedin, and St. Kilda to widen and extend Streets in their respective Boroughs, and for these Purposes to borrow Money.
Preamble.
WHEREAS certain streets in the Boroughs of Caversham, South Dunedin, and St. Kilda are too narrow, and it is desirable that, for the purpose of widening the said streets and of extending them if necessary, special powers should be given to the said Boroughs of Caversham, South Dunedin, and St. Kilda respectively:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Caversham, South Dunedin, and St. Kilda Streets Improvement Act, 1883.”
2 Interpretation.
In this Act, if not inconsistent with the context,—
“The Corporation of the Borough of Caversham” means the Corporation of the Mayor, Councillors, and Burgesses of the Borough of Caversham:
“The Corporation of the Borough of South Dunedin” means the Corporation of the Mayor, Councillors, and Burgesses of the Borough of South Dunedin:
“The Corporation of the Borough of St. Kilda” means the Corporation of the Mayor, Councillors, and Burgesses of the Borough of St. Kilda:
“Owner” of any property means the person for the time being entitled to the rack-rent thereof, or any person entitled to a beneficial interest therein, either in possession or reversion:
“A notice” required by this Act to be given to any person means a notice in writing, either delivered to him personally or to his agent, or left at his usual or last known place of abode or business.
3 Corporation of Caversham may widen certain streets.
The Corporation of the Borough of Caversham shall have power to widen all or any of the streets described in the First Schedule hereto, or a part or parts of any of such streets, from time to time: Provided that such streets when widened shall not have a greater width than sixty-six feet, measured at right angles to the course of the street, available for the ordinary traffic of vehicles and passengers, and to extend the street called Wilkie Road to the Hillside Road in manner described in the said First Schedule.
4 And may appropriate money for this purpose.
For the purpose of effectuating the powers conferred on it by the last clause, it shall be lawful for the said Corporation of Caversham to appropriate any sum or sums of money heretofore borrowed or authorized to be borrowed for the purpose of widening the streets of the said borough.
5 Corporation of South Dunedin may widen certain streets.
The Corporation of the Borough of South Dunedin shall have power to widen all or any of the streets described in the Second Schedule hereto, or a part or parts of any of such streets, from time to time: Provided that such streets when widened shall not have a greater width than sixty-six feet available for the ordinary traffic of vehicles and passengers, measured at right angles to the course of the street.
6 Corporation of St. Kilda may widen certain streets.
The Corporation of the Borough of St. Kilda shall have power to widen all or any of the streets described in the Third Schedule hereto, or a part or parts of any such streets, from time to time: Provided that such streets when widened shall not have a greater width than sixty-six feet available for the ordinary traffic of vehicles and passengers, measured as aforesaid.
7 Boundary streets.
If any street or streets authorized to be widened by this Act form a boundary between any two of the before-mentioned boroughs, such two boroughs shall bear the costs and expenses of widening such boundary, street, or streets between them in equal shares.
8 Power to borrow.
The said Corporations may respectively pass resolutions to raise and borrow, on the security of such separate rates as are authorized to be levied by “The Municipal Corporations Act, 1876,”
or any statutory modification or re-enactment thereof, such sum or sums of money as may be necessary for the purpose of carrying into effect the provisions of this Act; but any such resolution shall not be acted upon until a vote of the ratepayers within the areas rated shall have been taken, in terms of Part Ten of “The Municipal Corporations Act, 1876,”
and any Act amending the same.
9 As to taking polls on special loans.
Such poll shall be taken in the same manner as polls on special loans are prescribed to be taken by section one hundred and forty-two of “The Municipal Corporations Act, 1876.”
10 Notice to be given of result of poll.
The Mayor shall forthwith, after the result of such poll shall have been declared, give public notice of the number of votes recorded for and against the proposal to borrow and raise money as aforesaid, and such notice shall be deemed to be conclusive evidence that such proposal has been carried or rejected, as the case may be.
SCHEDULES
FIRST SCHEDULE
Caversham Valley Road to be widened from Main South Road to Industrial School; Main South Road to be widened from railway bridge to Forbury Road; Forbury Road to be widened from Main South Road to the Ocean Beach, part of the Forbury Road forming the boundary between South Dunedin and Caversham, and another part also forming the boundary between St. Kilda and Caversham; David Street to be widened from Main South Road to Forbury Road; Cargill Road and Caledonian Road to be widened from Anderson’s Bay Road to Forbury Road, being the boundary between South Dunedin and Caversham; Glen Road to be widened from Main South Road to the boundary of the borough of Mornington; Wilkie Road to be extended from its present terminus to the Hillside Road; Hillside Road to be widened from Park Street, Kensington, to Cargill Road; Bay View Road or Kennedy Road to be widened throughout that portion of it which forms the boundary between the Boroughs of St. Kilda and Caversham.
SECOND SCHEDULE
The following streets in the Borough of South Dunedim to be widened throughout their entire length: In the East Ward of the said borough—Braemar Street, Waverley Street, Broughton Street, Rankeillor Street, Argyle Street, Sydney Street, Adelaide Street, Ross Street, Regent Street, Melbourne Street, Oxford Street, Jones Street, Cashel Street, George Street, Thomas Street. In the South Ward of the said borough—Vogel Street, Fox Street, Hall Street, Stafford Street, Gisborne Street, Dick Street. In the North Ward of the said borough—Maria Street, Reid Street, Cutten Street, Duncan Street, Bradshaw Street, Brunswick Street, Nelson Street, Richmond Street, Surrey Street, Richmond Road, Cross Street, Nicholson Street, Bathgate Street, Osmond Street, William Street, Russell Street.
The following streets or roads in the said Borough of South Dunedin to be widened as follows: Cargill Road, being the boundary between South Dunedin and Caversham, to be widened from Anderson’s Bay Road to Forbury Road; Main or Hillside Road, from Cargill Road to View Street; Macandrew Road, from Anderson’s Bay Road to Forbury Road, part of Macandrew Road being the boundary between South Dunedin and Caversham; Bay View Road, View Street, and Kennedy Road, that portion which forms the boundary between South Dunedin and St. Kilda.
THIRD SCHEDULE
The following streets in the said Borough of St. Kilda to be widened: Bay View Road, View Street, and Kennedy Road, that portion which forms the boundary between the Boroughs of South Dunedin and St. Kilda, and also that portion which forms the boundary between the Boroughs of St. Kilda and Caversham; Prince Albert Street, from View Street to the Ocean Beach, Queen’s Drive, and Queen’s Avenue, Musselburgh.
