An Act to enable the Corporation of the Town of Invercargill to convey certain Lands in the Town of Invercargill, in exchange for certain other Lands in the said Town.
Preamble.
WHEREAS by Crown grant dated the twentieth day of June, one thousand eight hundred and sixty-two, registered number twelve thousand eight hundred and sixty-two in the books of the Registrar of Deeds for the District of Southland, certain lands, including the lands comprised in the First Schedule hereto, were granted to the then Superintendent of the then Province of Southland in trust as an endowment for the improvement and benefit of the Town of Invercargill: And whereas by deed of conveyance dated the eleventh day of June, one thousand eight hundred and seventy-nine, registered number twelve thousand eight hundred and sixty-three in the books of the Registrar of Deeds for the District of Southland aforesaid, the said lands were vested in the Corporation of the Town of Invercargill on the trusts aforesaid: And whereas by Crown grant dated the twenty-fifth day of September, one thousand eight hundred and seventy-eight, registered in the Southland Land Registry, volume thirteen, folio thirty-nine, the parcel of land firstly described in the Second Schedule hereto was vested in James Alexander Robertson Menzies, James Blacklock, William John Moffett, and Neil Ferguson, their heirs and assigns: And whereas by Crown grant dated the twenty-fifth day of September, one thousand eight hundred and seventy-eight, registered in the Southland Land Registry, volume thirteen, folio forty, certain lands, including the parcel of land secondly described in the said Second Schedule hereto, were vested in the said James Alexander Robertson Menzies, James Blacklock, William John Moffett, and Neil Ferguson, their heirs and assigns: And whereas the said James Alexander Robertson Menzies, James Black-lock, William John Moffett, and Neil Ferguson, their heirs and assigns, held the lands described in the said Second Schedule in trust and for the benefit of the Southland Caledonian Society: And whereas the said Southland Caledonian Society is incorporated under the provisions of the Joint-Stock Companies Acts: And whereas it has been considered advisable, and is now agreed upon, that the land vested in the Corporation of the Town of Invercargill, described in the First Schedule hereto, should be exchanged for the land described in the Second Schedule:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Invercargill Reserves Exchange Act, 1883.”
2 Corporation of the Town of Invercargill may exchange land in First Schedule with Southland Caledonian Society for land in Second Schedule.
It shall be lawful for, and the Corporation of the Town of Invercargill are hereby authorized and empowered to convey to the said Southland Caledonian Society, under their corporate seal, all that parcel of land comprised in the First Schedule hereto, on the lands comprised in the Second Schedule hereto being transferred to the said Corporation of the Town of Invercargill, to be held on like trusts as are comprised or contained in the said Crown grant of the twentieth day of June, one thousand eight hundred and sixty-two, registered number twelve thousand eight hundred and sixty-two, and in the said deed of conveyance of the eleventh day of June, one thousand eight hundred and seventy-nine, registered number twelve thousand eight hundred and sixty-three.
SCHEDULES
FIRST SCHEDULE
All that parcel of land in the Provincial District of Otago, being Section No. 3 of Block XLV., Invercargill. Bounded on the North by Eye Street, 100 links; on the East by Section No. 4 of said block, 250 links; on the South by Section No. 20 of said block, 100 links; and on the West by Section No. 2 of said block, 250 links. Also all that parcel of land in the Provincial District of Otago aforesaid, being Section No. 13 of Block XLV. aforesaid. Bounded on the North by Section No. 10 of said block, 100 links; on the East by Section No. 12 of said block, 250 links; on the South by Tweed Street, 100 links; and on the West by Section No. 14 of said block, 250 links.
SECOND SCHEDULE
Firstly, all that parcel of land situate in the Provincial District of Otago, being Section No. 12 of Block XL., Invercargill. Bounded on the North by Section No. 11 of said block, 100 links; on the East by Ythan Street, 250 links; on the South by Ettrick Street, 100 links; and on the West by Section No. 13 of said block, 250 links. Secondly, all that parcel of land situate in the Provincial District of Otago aforesaid, being Section No. 20 of Block XL. aforesaid. Bounded on the North by Section No. 3 of said block, 100 links; on the East by Section No. 19 of said block, 250 links; on the South by Ettrick Street, 100 links; and on the West by Section No. 21 of said block, 250 links.
