An Act to authorize the Borough of Caversham to make Deviations in certain Drainage Works which have been authorized to be carried out.
Preamble.
WHEREAS the Council of the Borough of Caversham, in the Provincial District of Otago, published in the said borough a notice setting forth certain particular works for the purpose of drainage and other purposes within the said borough, proposed to be undertaken by the said Council; also, that the sum of twenty thousand pounds was proposed to be borrowed for the purposes of such works, on the security of the general rates of the said borough: And whereas the Colonial Secretary published in the New Zealand Gazette of the twenty-fifth day of January, one thousand eight hundred and eighty-three (number nine), a notice, which he had received from the Mayor of the said borough, that, at a poll taken in the said borough of the burgesses on the roll of the said borough on the said proposal, the number of votes given for the said proposal exceeded one-half of the total number of burgesses, and that he the said Mayor had declared the proposal carried: And whereas it would be to the advantage of the said borough that a deviation from the works for the purpose of drainage comprised in the said resolution should be made: And whereas particulars of portions of the said works for drainage included in the said proposal and resolution are set forth in the First Schedule:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Caversham Drainage Act, 1884.”
2 Borough may omit to carry out works in First Schedule, and may carry out works in Second Schedule.
It shall be lawful for the said Borough of Caversham, in carrying out the works and drainage contained in the proposal aforesaid, and in the resolution so carried at the poll as aforesaid, to omit to carry out the works for the purpose of drainage contained in the First Schedule, and, in substitution of such works contained in the First Schedule, to carry out the several works for the purpose of drainage contained in the Second Schedule.
3 Council may apply moneys borrowed in pursuance of proposal and resolution in effecting substituted works.
It shall he lawful for the Council for the said borough to appropriate and apply such of the moneys borrowed in pursuance of such proposal and resolution as aforesaid as the Council shall think fit in effecting such works as are set forth in the Second Schedule hereto, the proposal and resolution aforesaid notwithstanding.
SCHEDULES
FIRST SCHEDULE
South Ward.—Construction of 3ft. 6in by 2ft. 6in brick culvert from the junction of David Street and the Main South Road along David Street to the junction of David Street and Forbury Road. Continuation of brick culvert 4ft by 3ft from the junction of David Street with Forbury Road to Kew Store on Cargill Road; length, 6 chains.
Middle Ward.—Cargill Road: Thirty-seven chains of 18-inch drain-pipes. McGlashan Street: Culvert and formation, 11 chains.
Kensington Ward.—Cargill Road: Eighteen-inch drain-pipes, 20 chains.
SECOND SCHEDULE
South, Middle, and Kensington Wards.—Brick culvert from junction of David Street with the Main South Road, along the Main South Road to Wilkie Road, along the Wilkie Road to and crossing the St. Kilda Road, along Cameron Street through portion of the property of the Otago Presbyterian Church Board of Property, to Anderson’s Bay Road, and along the Anderson’s Bay Road to Cargill Road. Box-drain from the junction of David Street and Cargill Road along Cargill Road to Anderson’s Bay Road.
South Ward.—Fifteen-inch and eighteen-inch drain-pipes from the junction of the Main South Road and David Street along David Street to Cargill Road.
Middle Ward.—Drain-pipes along McGlashan Street.
