An Act to amend “The Otago Dock Act, 1883.”
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same as follows:—
1 Short Title.
The Short Title of this Act is “The Otago Dock Act 1883 Amendment Act, 1885.”
2 Constitution of Dock Trust.
The Mayor of the City of Dunedin, the Mayor of the Borough of Port Chalmers, the Chairman of the Otago Harbour Board, the President of the Dunedin Chamber of Commerce, and their successors in their several offices, together with two persons elected by the Council of the Borough of Port Chalmers, and two persons nominated by the Governor, and their successors, are hereby constituted a body politic and corporate, by the name and style of “The Otago Dock Trust,”
and by that name shall have perpetual succession and a common seal.
3 Powers of Trust.
The Otago Dock Trust and its successors (hereinafter called “the Trust”
), shall have full power and authority to do all matters and things incidental to or appertaining to a corporate body, subject nevertheless to any provisions in this Act or in “The Otago Dock Act, 1883,”
contained affecting such powers.
4 Vacancies.
When any member of the Trust shall die, resign, cease to hold the office in respect of which he is such member, or be absent from the colony for the space of six consecutive months, his office as a member of the Trust shall be vacated, and the Governor shall appoint, either permanently or temporarily, as occasion may require, another or other fit and proper person or persons to be a trustee or trustees in the room of the trustee or trustees whose office is vacated.
5 Trust to take the place of Otago Harbour Board.
All powers and authorities granted or conferred by “The Otago Dock Act, 1883”
(herein referred to as “the said Act”
), to or upon the Otago Harbour Board in relation to the construction of a graving dock and of borrowing money for the purpose, in manner as in the said Act mentioned, are hereby transferred to and shall vest in the Trust constituted under this Act, with full powers to exercise the same subject to the said Act.
All lands and endowments granted to or vested in the Otago Harbour Board under the said Act, or under any other Act or enactment for the purpose of such dock, shall vest in the Trust constituted under this Act and their successors for the same purpose.
All money borrowed, and all rents, issues, and profits to be received, by the aforesaid Board under the said Act shall be received by the Trust, and applied by it as in the said Act is directed.
6 Interpretation.
The said Act and every Act or enactment passed in amendment thereof shall be read as if in the place of the words “Otago Harbour Board”
and “Board”
there had been originally inserted therein the words “Otago Dock Trust”
and “Trust.”
Act to be deemed a special Act.
This Act shall be deemed to be a special Act within the meaning of “The Harbours Act, 1878,”
in like manner and as fully as if the Trust were a Harbour Board, and “The Harbours Act, 1878,”
is hereby incorporated with this Act.
7 Commencement of Act.
This Act shall come into force on such day, not earlier than the first day of January, one thousand eight hundred and eighty-six, as may be fixed by Proclamation by the Governor to that effect: Provided that no such Proclamation shall be issued in case the Governor in Council is satisfied that, at any time previous to such day, valid contracts have been executed by the Otago Harbour Board for the commencement and the proper continuance of the work of constructing a dock as required by the said Act.
