An Act to constitute the Tamaki West Licensing District, and to Validate all things irregularly done therein under “The Licensing Act, 1881.”
Preamble.
WHEREAS by Proclamation of the twentieth day of January, in the year one thousand eight hundred and eighty-two, the Licensing Districts of Mount Wellington and Tamaki West, in the County of Eden, were respectively constituted under “The Licensing Act, 1881”
(hereinafter referred to as “the said Act”
); and it being found that there were not a hundred ratepayers in the Tamaki West District, it became therefore necessary to extend the said district:
And whereas a Proclamation was issued on the seventeenth day of January, in the year one thousand eight hundred and eighty-three, reconstituting the aforesaid districts, and by the said Proclamation the Township of Panmure was excluded from the Mount Wellington District, with the intention of including the same within the Tamaki West District, but by some error it was omitted to be included in the district last-named:
And whereas by notification in the Gazette of the nineteenth day of February, one thousand eight hundred and eighty-three, the Governor appointed the Panmure Road Board to be the local body to have authority under the said Act throughout the Tamaki West District, and the said Board have exercised such authority accordingly under the said Act, and a poll of ratepayers as to the increase of licenses has been held in the said district, under the name of the Panmure Licensing District, and a Licensing Committee has been elected therein, which have granted licenses therein, and done other acts under the said Act within a district indifferently called the Panmure Licensing District and the Panmure and Tamaki West Licensing District:
And whereas in the meanwhile the operation of the said Act within the Tamaki West Licensing District as at present constituted has been virtually suspended, and no licenses can be granted therein by reason of a poll of the ratepayers therein not having been legally taken according to the requirements of the said Act:
For the rectification of all these errors and irregularities:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Tamaki West Licensing District Act, 1887.
2 Tamaki West Licensing District defined.
The Tamaki West Licensing District, as proclaimed on the seventeenth day of January, one thousand eight hundred and eighty three, shall, notwithstanding any error contained in the Proclamation describing the boundaries of the said district, be deemed to include and to have included, from the date of the aforesaid Proclamation, the area described in the aforesaid Proclamation, together with the Township of Panmure, and section three of the suburban lots thereof, and also allotments numbers forty, forty-one, and forty-two of the Parish of Waitemata, and shall be known by the name aforesaid (hereinafter referred to as “the said district”
).
Nothing herein contained shall preclude the said district from being altered, abolished, or reconstituted from time to time under the said Act.
3 Panmure Road Board deemed to have had licensing authority therein.
The Panmure Road Board shall be deemed to have been from and after the nineteenth day of February, one thousand eight hundred and eighty-three, the local body having authority throughout the whole of the said district.
4 Elections and poll of ratepayers validated. All things done in error confirmed.
All acts, matters, and things done, performed, or suffered under the said Act within any part of the aforesaid district under whatsoever name such district may have been described for the time being shall be deemed to have been valid for all purposes, and to have been done, performed, or suffered for or in the said district; all elections of Committees shall be deemed to have been good, and the members of the said Committees to have been duly elected as members of the Licensing Committee of the said district, all polls of ratepayers taken under the said Act, and all licenses granted or other business transacted within any part of the said district by a Committee elected as aforesaid shall be deemed to have been duly and validly done under the said Act within the Tamaki West District, as constituted under section two of this Act.
