An Act to authorise the Mount Somers Road Board to sell Part of Reserve One thousand six hundred and thirty-one, in the Provincial District of Canterbury, with the Buildings erected thereon.
Preamble.
WHEREAS a piece of land situate in the Provincial District of Canterbury, containing one acre and two roods or thereabouts, being reserve one thousand six hundred and thirty-one, in the Alford Survey District, was set apart by the Provincial Government of Canterbury for Road Board purposes, and the whole of the said land is no longer required for the said purposes: And whereas the buildings erected upon part of the said land, and which are the joint property of the Mount Somers Road District, the Mount Hutt Road District, and the Anama Road District, being also no longer required for Road Board purposes, it is desirable that so much of the said land as is not required, with the said buildings thereon, should be sold:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Mount Somers Road Board Empowering Act, 1888.”
2 Mount Somers Road Board may sell part of Reserve 1631.
It shall be lawful for the Mount Somers Road Board to sell and dispose of, either by public auction or by public tender, as it may think fit, such part of said reserve one thousand six hundred and thirty-one, with the buildings erected thereon, as the Boards of the Mount Somers Road District, the Mount Hutt Road District, and the Anama Road District shall, by resolution severally passed by the said Boards, determine to be no longer required for Road Board purposes, and may do all things necessary to give effect to such sale.
3 Proceeds of sale, how applied.
The proceeds to arise out of such sale shall be forthwith divided between the said three road districts in accordance with the terms of the agreement in that behalf made between the Boards of the said districts at the time of the separation of the Mount Somers Road District, the Mount Hutt Road District, and the Anama Road District, the one from the other.
4 Mount Somers Road Board may execute conveyance.
The said Mount Somers Road Board may make and execute to the purchaser of the land hereinbefore authorised to be sold all such conveyances and other assurances as may be required to vest the legal estate of the said land in the purchaser thereof, in like manner as if the said Road Board had been the absolute owner of an estate of inheritance in fee-simple in the said land.
5 Certificate of title may issue.
On the delivery to him of any such conveyance or other assurance as aforesaid, together with a copy of this Act, the District Land Registrar of Canterbury shall issue to the person therein named as purchaser of the aforesaid land a certificate of title for the same under “The Land Transfer Act, 1885.”
