An Act to empower the Governor to carry out an arrangement for the Compensation to be made to Archibald Hilson Ross, of Opotiki, for Land taken for Road from Opotiki to Waiotahi.
Preamble.
WHEREAS a promise was made to Archibald Hilson Ross, of Opotiki, Settler, that the land described in the First Schedule hereto should be given to him, and a right-of-way over the land described in the Second Schedule be granted to him, in exchange and as full compensation for the land described in the Third Schedule, which was taken from him for the Opotiki to Waiotahi Road, and for damage done to other part of his land by the construction of the said road; and also in consideration of the expense caused to him by the alteration and addition to the fencing required for the protection of his land as altered by the aforesaid exchange: And whereas it is desirable to give effect to such promise: And whereas the lands described in the First and Second Schedules are Crown lands vesting in Her Majesty:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Ross Compensation Act, 1888.”
2 Empowering Governor to grant certain land to A. H. Ross, on his conveying certain land to the Queen.
On receiving from the aforesaid Archibald Hilson Ross a conveyance to Her Majesty the Queen of the land described in the Third Schedule hereto, the Governor may declare the portion of original road-line mentioned in the First Schedule to be closed, anything in “The Public Works Act, 1882,”
or any other Act to the contrary notwithstanding; and may grant such portion of the original road-line, together with the other land described in the said First Schedule, to the said Archibald Hilson Ross, and may also, by warrant under his hand publicly notified, declare that the land described in the Second Schedule shall be a public road, and such land shall thereupon become a public road accordingly.
SCHEDULES
FIRST SCHEDULE
All that piece of land containing approximately 60 acres, being portions of Sections Nos. 428 and 421, Block V., Opotiki, and the original road-line adjacent thereto, namely, that portion of Section No. 428, with original road-lino, bounded on the south by Section No. 430; on the east by Section No. 421; and generally westerly and north-westerly by the Opotiki-Waiotahi Road, as diverted; together with that Sortion of Section No. 421, with original road-line, bounded on the west by Section No. 428; on the south by Section No. 431; and generally north-easterly and easterly by the Opotiki-Waiotahi Road, as diverted; as shown approximately on plan mentioned below, and thereon coloured yellow.
SECOND SCHEDULE
A road, 5 chains in width, over Section No. 432, Block IX., Opotiki, to connect Section No. 431 with Section No. 451; as shown approximately on plan mentioned below, and thereon coloured brown.
THIRD SCHEDULE
All that piece of land containing approximately 5 acres, being a strip of land 1 chain wide required for the Opotiki-Waiotahi Road, as diverted, commencing at a point on the southern boundary of Section No. 416, Block VI., Opotiki, and running generally in a north-easterly direction for an approximate distance of 50 chains to a point on the eastern boundary of the said section near its north-eastern corner; as shown approximately on plan mentioned below, and thereon coloured blue.
Also all that piece of land containing approximately 11 acres, being a portion of Section No. 431, Block V., Opotiki, and situated at the north-east corner thereof. Bounded generally south-westerly by the south-west side of the Opotiki-Waiotahi Road, as diverted; easterly and northerly by portions of the eastern and northern boundaries of the said Section No. 431; as shown approximately on plan mentioned below, and thereon coloured blue.
All the above parcels of land being situated in the County of Whakatane, in the Land District of Auckland; as the same are approximately delineated on the plan marked P.W.D. 15821, deposited in the office of the Minister for Public Works, at Wellington.
