An act to authorise the Auckland Harbour Board to exchange certain Freehold Land adjoining Calliope Dock for certain other Freehold Land fronting Victoria and Beach Roads, Devonport, and for other Purposes.
Preamble.
WHEREAS the land described in the First Part of the Schedule hereto is vested in the Auckland Harbour Board: And whereas the land described in the Second Part of the Schedule hereto is vested in the Commander-in-Chief or Officer Commanding Her Majesty’s Naval Forces on the Australian Station, for the time being, for naval purposes, under a certificate of title issued under the authority of “The Naval Reserves Vesting Act, 1890,”
and subject to the provisions contained in section three of the said Act: And whereas the first-mentioned piece of land being deemed more suitable for such purposes, it is proposed to exchange the said pieces of land, and it is desirable that the proposed exchange should be sanctioned by law: And whereas it is expedient that, after the said exchange has been effected, the said Board should be empowered to convey to the Corporation of the Mayor, Councillors, and Burgesses of the Borough of Devonport all that piece of land described in the Third Part of the Schedule hereto, and which is now used for municipal offices for the said borough: And whereas by “The Auckland Harbour Board Empowering Act, 1891,”
the Auckland Harbour Board was empowered to contract with certain owners of land bounded by St. George’s Bay, Parnell, for the purpose of settling the seaward boundary of such owners’ land, and for the extinction and surrender of lights of water-frontage: And whereas such owners are desirous of obtaining a frontage to a road in lieu of and in consideration of the surrender of such rights of water-frontage, and for such purposes it is expedient that the Auckland Harbour Board should be empowered to lay out and dedicate a road on and over the land described in the Fourth Part of the Schedule hereto:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Auckland Harbour Board Empowering Act, 1892.”
2 Interpretation.
In this Act, if not inconsistent with the context, “The Board”
shall mean the Auckland Harbour Board.
3 Conveyance of certain lands by Board to Commander-in-Chief on the Australian Station.
It shall be lawful for the Board, and it is hereby authorised and empowered, to convey and assure unto the Commander-in-Chief or Officer Commanding Her Majesty’s Naval Forces on the Australian Station for the time being, in exchange for the piece of land described in the Second Part of the Schedule hereto, all that piece or parcel of land described in the First Part of the Schedule hereto, in fee-simple, for naval purposes, and to be held subject to the conditions contained in section three of “The Naval Reserves Vesting Act, 1890.”
4 Transfer of land by Commander-in-Chief of certain lands to Board.
It shall be lawful for the Commander-in-Chief or Officer Commanding Her Majesty’s Naval Forces on the Australian Station for the time being, and be is hereby authorised and empowered, anything contained in “The Naval Reserves Vesting Act, 1890,”
notwithstanding, to transfer to the Board, in fee-simple, all those pieces or parcels of land described in the Second Part of the Schedule hereto, to be held by the Board for the same trusts and purposes upon and which the land described in the First Part of the Schedule hereto is now held by the Board.
5 Conveyance of certain lands by Board to Mayor, Councillors, and Burgesses of Borough of Devonport.
It shall be lawful for the Board, and it is hereby authorised and empowered, at any time after the said exchange shall have been effected, to convey to the Corporation of the Mayor, Councillors, and Burgesses of the Borough of Devonport all that piece or parcel of land described in the Third Part of the Schedule hereto, as a site for Borough Council offices, public buildings, and public library.
6 Authorisation of road.
It shall be lawful for the Board, and it is hereby authorised and empowered, to lay out and dedicate to the use of the public, as and for a road, all that piece or parcel of land described in the Fourth Part of the Schedule hereto.
Schedule
FIRST PART
ALL that piece or parcel of land in the Land District of Auckland, in the Colony of New Zealand, being portion of reclaimed land east of the Calliope Bay, containing 4 acres, more or less, situate in the Parish of Takapuna. Bounded on the north by the Beach Road, 961·7 and 406 links; on the south by the top of the seawall, 470 and 900 links; and on the west by the Calliope Dockyard, 517·5 links.
SECOND PART
All that piece or parcel of land in the Land District of Auckland, in the Colony of New Zealand, being Lot No. 22b of Section No. 2, containing 1 acre and 12 perches, more or less, situate in the Parish of Takapuna. Bounded on the north-east by Clarence Street, 497 links; on the south-east by the Beach Road, 640 links; and on the north-west by Victoria Road, 421.2 links.
Also all that piece or parcel of land in the land district aforesaid, being Lot No. 22c of said Section No. 2, containing 2 acres and 16 perches, more or less, situate in the said Parish of Takapuna. Bounded on the north-west by the Beach Road, 583·8 links; on the east by portion of a reserve 10 links, and the high-water mark of the Auckland Harbour; on the south by high-water mark of the Auckland Harbour; and on the west by Victoria Road, 421·1 links.
THIRD PART
All that piece or parcel of land in the Land District of Auckland, in the Colony of New Zealand, being a portion of Lot No. 22b of Section No. 2, containing 8 perches, more or less, situate in the Parish of Takapuna. Bounded on the west by the Victoria Road, 160 links; on the north-east by other part of said Lot No. 22b, 136 links; and on the south-east by the Beach Road, 160 links.
FOURTH PART
All that piece or parcel of land in the Land District of Auckland, in the Colony of New Zealand, being portions of St. George’s Bay and St. Barnabas Point. Bounded on the north-east by a portion of St. Barnabas Point and the waters of the Auckland Harbour, 2000 links; on the south-east by the abutment of the St. George’s Bay Road; on the south-west by the seaward boundaries of Lots Nos. 62 and 65 of Section No. 1 of the Suburbs of Auckland, by the abutment of Selwyn Terrace, and by a portion of St. Barnabas Point; and on the north-west by high-water mark of St. Barnabas Point and the abutment of the sea-wall crossing Mechanics’ Bay.
