An Act to empower the Mayor, Councillors, and Citizens of the City of Wellington to transfer a Parcel of Land situate in the City of Wellington to the Owners of certain Lands in the Vicinity thereof.
Preamble.
WHEREAS by a judgment of the Court of Appeal of New Zealand dated the fourteenth day of July, one thousand eight hundred and ninety, in an action in the Supreme Court of New Zealand (Wellington District) between the New Zealand Loan and Mercantile Agency Company (Limited), plaintiff, and the Mayor, Councillors, and Citizens of the City of Wellington, defendants, and numbered “4787,”
it was adjudged that the plaintiff had established a right to the access of light to certain windows in a building situate on the land of the plaintiff, being lots numbered twenty-four and twenty-five on the plan of certain land reclaimed from the Harbour of Port Nicholson, and being part of the land comprised in a certificate of title, volume forty-three, folio ninety, over the parcel of land owned by the defendants, and described in the Schedule hereto, and certain other lands owned by the defendants: And whereas differences have arisen between the said plaintiff and defendants as to the extent of the said right of light: And whereas, with a view to settling such differences, it has been agreed between the said plaintiff and defendants, conditionally upon the necessary legislative authority in that behalf being acquired by the said defendants, that the said defendants should exchange the said parcel of land described in the said Schedule for certain other land in the vicinity thereof owned by the said plaintiff, upon and subject to certain terms and conditions:
Be it therefore enacted by the General Assembly of New Zealand, in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Wellington City Empowering Act, 1893.”
2 Wellington Corporation may transfer a parcel of land to the New Zealand Loan and Mercantile Agency Company (Limited) in exchange.
It shall be lawful for the Mayor, Councillors, and Citizens of the City of Wellington, with a view to settling the differences which have arisen between them and the New Zealand Loan and Mercantile Agency Company (Limited) as aforesaid as to the extent of the right of light established by the said judgment of the Court of Appeal of New Zealand, to transfer to the said company or other the owners for the time being of the said lots numbered twenty-four and twenty-five the fee-simple of the parcel of land described in the Schedule hereto, in exchange for any land in the City of Wellington owned by the said company or other such owners for the time being as aforesaid, upon and subject to such terms and conditions as may be mutually agreed upon.
Schedule
All that piece or parcel of land situated in the City of Wellington, containing 12 perches more or less: Commencing at the junction of the south-east side of Customhouse Quay with the south-west side of Hunter Street extension, the said point being distant 84 links and 9–10ths of a link, and bearing 183 degrees 6 minutes and 20 seconds from the Government Standard Survey Block at the intersection of the said streets; thence by a straight line south-westerly along Customhouse Quay on a bearing of 202 degrees 59 minutes for a distance of 41 links and 3–100ths of a link, such point being the northernmost corner of Lot 25, Reclaimed Land, Wellington; thence by a straight line south-easterly on a bearing of 112 degrees 59 minutes for a distance of 87 links and 87–100ths of a link, along the north-east boundary of the said Lot 25 and the north-east boundary of Lot 33 of Land Transfer deposited Plan 331, such point being the easternmost corner of the aforesaid Lot 33; thence by a straight line south-westerly on a bearing of 202 degrees 59 minutes for a distance of 53 links and 18–100ths of a link along the eastern boundary of the aforesaid Lot 33, such point being the southernmost corner thereof; thence by a straight line south-easterly along the northern boundary of the land comprised in Land Transfer certificate of title, Volume 43, Folio 90, on a bearing of 112 degrees 59 minutes, for a distance of 43 links and 55–100ths of a link, such point being an angle in the wall of the New Zealand Loan and Mercantile Agency Company’s (Limited) brick building; thence by a straight line north-easterly on a bearing of 23 degrees 7 minutes for a distance of 94 links and 6–10ths of a link to Hunter Street extension; thence by a straight line north-westerly on a bearing of 292 degrees 49 minutes for a distance of 131 links and 62–100ths of a link along Hunter Street extension to the point of commencement.
