An Act authorising the Sale of certain Lands in the Town of Kaitangata intended as a Site for a Public Cemetery.

Preamble.

WHEREAS the land described in the Schedule hereto is situated within the Borough of Kaitangata, and is vested in the Corporation of the Mayor, Councillors, and Burgesses of the Borough of Kaitangata as a site for a public cemetery: And whereas section forty-nine of “The Cemeteries Act, 1882,” provides that, after the commencement of that Act, no cemetery or burial-ground of any kind shall be established within the limits of a borough: And whereas the said Corporation desire to sell the said land, and with the proceeds of such sale purchase land outside the limits of the said borough as a site for a public cemetery:

Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title.

The Short Title of this Act is “The Kaitangata Cemetery Site Sale Act, 1893.”

2 Kaitangata Borough Council empowered to sell the land described in the Schedule.

It shall be lawful for the Corporation of the Mayor, Councillors, and Burgesses of the Borough of Kaitangata to sell by public auction or public tender, either together or in lots, and on such terms as they may think fit, the parcel of land described in the Schedule hereto, and to execute all necessary deeds and other assurances in favour of the purchaser or purchasers, or as he or they may direct.

3 Mode of application of purchase-money.

The proceeds of such sale, as hereinbefore mentioned, shall be devoted to the following purposes: First, to the payment of all reasonable charges incurred by the said Corporation in connection with the passing of this Bill; and, secondly, in purchasing a site for a cemetery outside the limits of the Borough of Kaitangata, and in improving and ornamenting such site.

Schedule

All that parcel of land in the Land District of Otago, containing by admeasurement 5 acres 2 roods, more or less, situate in the Town of Kaitangata, and being Sections Nos. 1 to 22, inclusive, of Block XV. Bounded toward the north-east by Hurst Street; towards the south-east by Salcombe Street; towards the south-west by Cowes Street; and towards the north-west by Eddystone Street.
