An Act to enable the Westland County Council to lease a Portion of a certain Reserve of Land to Stephen Glossop, of Hokitika.
Preamble.
WHEREAS certain lands, including the land mentioned in the Schedule hereto, are vested in the Chairman, Councillors, and Inhabitants of the Westland County (hereafter called “the county”
) for a road reserve: And whereas Stephen Glossop, of Hokitika, hotelkeeper, has built an accommodation-house on the said land for the benefit of tourists and others: And whereas the said Stephen Glossop has applied to the said county for a lease of the parcel of land on which the said house is built: And whereas the said county is willing to lease the said land to the said Stephen Glossop, but find that they have not the power to do so: And whereas the leasing of the said land will not in any manner interrupt the traffic on the road adjoining the said land: And whereas it is expedient to give the said county power to lease the said land to the said Stephen Glossop:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Westland County Council Enabling Act, 1894.”
2 Power to lease land.
It shall be lawful for the Westland County Council, notwithstanding the provisions of any Act to the contrary, to lease the land described in the Schedule hereto unto Stephen Glossop, of Hokitika, his executors, administrators, and assigns, for an estate of leasehold for such term or terms not exceeding twenty-one years, with or without a right of renewal for such further term or terms, as the said Council may think fit.
3 Land to vest when deed executed.
Upon any deed purporting to lease the said land to the said Stephen Glossop, his executors, administrators, and assigns, as aforesaid, being sealed with the corporate seal of the said county, the said parcel of land shall thereupon vest in the said Stephen Glossop for the estate therein mentioned.
4 Rent to form part of county funds.
The rent to be received for the said land shall be and form part of the funds of the said county.
5 Saving as to riparian rights.
No riparian rights shall be deemed to vest in the said Stephen Glossop, his executors, administrators, and assigns, by virtue of any such lease.
Schedule
All that parcel of land situate in Block XI., Kanieri Survey District, containing 35 perches, more or less, bounded by a line commencing at a point distant 60·2 links from Trig. V., Kanieri Lake, on a bearing of 77° 19’, and proceeding thence at a bearing of 175° 32’ a distance of 341 links; thence at a bearing of 85° 32’ a distance of 27 links to the Kanieri River; thence along the western bank of the Kanieri River to a line bearing 85° 32’ from the commencing-point, and thence by that line to the commencing-point aforesaid.
