WHEREAS by section numbered five of “The Invercargill Public Offices Site Act, 1875,” it was enacted that it should not be lawful for the Invercargill Athenaeum to make any building or erection on the block of land situate on the east side of the piece of land described in the Third Schedule thereto, and having a frontage of twenty feet on Esk Street and a depth of sixty-seven feet, nor to make any building or erection on the block of land situate on the west side of the land described in the Fourth Schedule thereto, and being part thereof, having a frontage of twenty-one feet in the Crescent and a depth of fifty-two feet on the west end and a depth of fifty-eight feet on the east end of the said block, but that each of the said two blocks of land should be used by the Invercargill Athenæum as a yard or passage only:

And whereas the said Invercargill Athenæum is desirous of erecting a building on the first mentioned and described block of land, for the purpose of extending the accommodation now existing for the said Invercargill Athenæum, and otherwise for the purposes of the said Invercargill Athenaeum:
