An Act to enable the Napier Municipal Corporation and the Napier Harbour Board to exchange certain Lands vested in them.

Preamble.

WHEREAS the Napier Municipal Corporation, being the owner of the lands described in the First Schedule hereto, and the Napier Harbour Board, being the owner of the lands described in the Second Schedule hereto, some time since agreed that, for the purposes of roads and for other purposes mutually advantageous to the said Corporation and to the said Board, an exchange of the said lands should be effected, and exchanged such lands accordingly: And whereas doubts have arisen as to the power of the said Corporation and the said Board to exchange such lands, and it is expedient to remove such doubts and to empower such exchange to be carried out:

BE IT THEREFORE ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title.

The Short Title of this Act is “The Napier Municipal Corporation and Napier Harbour Board Exchange of Lands Empowering Act, 1897.”

2 Interpretation.

In this Act,—

“The Corporation” means the Mayor, Councillors, and Burgesses of the Borough of Napier:

“The Board” means the Napier Harbour Board.

3 Power to exchange lands.

The Corporation shall have and be deemed to have had full power to exchange the lands described in the First Schedule, or any of such lands or any part thereof respectively, for the lands described in the Second Schedule, or for any of such lands or for any part thereof respectively, and the Board shall have and be deemed to have had full power to exchange the lands described in the Second Schedule, or any of such lands or any part thereof respectively, for the lands described in the First Schedule, or for any of such lands or for any part thereof respectively.

4 Power to execute deeds, &c.

The Corporation and the Board are hereby empowered to execute and do all such conveyances, transfers, assurances, and things as may be necessary to give effect to the exchange hereby authorised.

SCHEDULES

FIRST SCHEDULE

All that piece or parcel of land situated in the Land District of Hawke’s Bay, being portion of Town Section No. 628 on the plan of the Town of Napier, containing by admeasurement 30 perches, more or less. Bounded towards the northwest by right lines bearing 74° 49’ and 71° 54’, 521.5 links and 98.1 links respectively (being southern boundary of the Railway Reserve); thence towards the north-east by other part of said Town Section No. 628, 72.3 links, along a line bearing 161°; thence towards the south-west, south, south-east, and south-west respectively by the Whare-o-Maraenui Reserve, 51.2 links, 167.7 links, 332 links, and 112.8 links respectively, along right lines bearing 294° 39’, 265° 46’, 244° 24’, and 288° 32’ respectively.

Also, all that piece or parcel of land being other portion of the said Town Section No. 628, containing by admeasurement 4 perches, more or less. Bounded towards the north-west by other portion of said Town Section No. 628, 103.4 links, along a right line bearing 71°; thence towards the east by the Whare-o-Maraenui Reserve, 53.4 links, along a right line bearing 187° 42’; and thence towards the south-west by the Whare-o-Maraenui Reserve, 92.6 links, along a right line bearing 282° 01’.

Also, all that piece or parcel of land being other portion of said Town Section No. 628, containing 34 perches, more or less. Bounded towards the north-east by Wellesley Street, 380 links, along a line bearing 111° 16’; thence towards the south by the Whare-o-Maraenui Reserve, 308.1 links, along a line bearing 270° 10’; and thence towards the south-west by other portion of said Town Section No. 628, 144.3 links, along a line bearing 341°.

SECOND SCHEDULE

All that piece or parcel of land being part of the Whare-o-Maraenui Reserve, situated in the Land District of Hawke’s Bay, containing by admeasurement 21 perches, more or less. Bounded towards the north-east by Town Section No. 628 on the plan of the Town of Napier, 48.4 links, along a line bearing 114° 39’; thence towards the north-west by other part of said Town Section No. 628,133.9 links, along a line bearing 72° 49’, and 351.6 links, along a line bearing 76° 40’; thence towards the south-east by other part of the said Whare-o-Maraenui Reserve, 518.7 links, along a line bearing 251°; and thence towards the south-west by other portion of the said Whare-o-Maraenui Reserve, 72.6 links, along a line bearing 341°.

And also, all that piece or parcel of land being other portion of the said Whare-o- Maraenui Reserve, containing by admeasurement 14 perches, more or less. Bounded towards the north-west by said Town Section No. 628, Napier, 88.2 links, along a line bearing 78°; thence towards the north-east by other part of said Town Section No. 628, 73.5 links, along a line bearing 161°; thence towards the south-east by other part of the said Whare-o-Maraenui Reserve, 130 links, along a line bearing 251°; and thence towards the north-west by other part of the said Town Section No. 628, 94.3 links, along a line bearing 7° 42’.
