An Act to authorise the Sale or Exchange of certain Recreation Reserves at Little River.
Preamble.
WHEREAS under the authority of “The Public Domains Act, 1881,”
the management and administration of the parcels of land described in the First and Second Schedules hereto (hereinafter called “the reserves”
) are now vested in the Little River Domain Board (hereinafter called “the Board”
): And whereas the reserves are not suitable for the purposes of recreation, and it is desirable that authority should be given to the Board to sell or exchange them in order to acquire other lands more suitable for recreation purposes:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Little River Domain Board Empowering Act, 1898.”
2 Board may sell reserves and purchase other lands.
The Board may, with the consent of the Governor, sell any part of or the whole of the reserves, and shall invest the moneys obtained by such sale in the purchase of other lands at Little River more suitable for recreation purposes, or may exchange any part of or the whole of the reserves for other lands at Little River more suitable for recreation purposes. A memorandum of transfer signed by the Chairman and two members of the Board at the time of any such sale shall, notwithstanding anything in “The Public Domains Act, 1881,”
or any other Act, be sufficient to vest the fee-simple of the land sold in any purchaser. And the District Land Registrar at Christchurch shall, upon application made to him verifying such sale, and on a proper plan of the land sold being lodged with him, issue a certificate of title under “The Land Transfer Act, 1885,”
to any such purchaser.
3 Lands purchased to vest in Crown.
All lands so purchased or acquired in exchange shall be vested in Her Majesty the Queen and managed and administered by the Board in the same manner as the reserves.
4 Board may erect a public library and a hall, and lay down recreation-grounds.
The Board may, out of any moneys in their possession, or out of the income derived from such reserves or the land acquired as aforesaid, erect on the land so managed and administered by them a public library and a hall with suitable appliances, and may lay down tennis-courts, cricket-pitches, and such other appliances for recreation purposes as they may deem desirable, and may make such regulations for the fees to be charged for such public library and hall and for the management thereof and of such appliances as they may think fit.
