An Act to empower the Clyde Town Board to sell Section Number Twelve, in the Clyde Town District, and to apply the Net Proceeds thereof in the Purchase of other Land for a Public Domain in the Town of Clyde.
Preamble.
WHEREAS the land described in the Schedule hereto is portion of a reserve set apart as a public domain in the Town of Clyde, Land District of Hawke’s Bay: And whereas under “The Public Domains Act, 1881,”
certain powers in connection therewith were delegated by the Governor to the Clyde Town Board by an Order in Council dated the seventeenth day of January, one thousand eight hundred and eighty-seven: And whereas the said land has been so cut up by a public road having been made through it by the Wairoa County Council that it is rendered unsuitable for the purpose of a domain, insomuch so that it is now disused for that purpose, the inhabitants being deprived of a recreation-ground: It is therefore desirable to dispose of the said land and to purchase other land in lieu thereof:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Clyde Recreation-ground Sale and Disposal Act, 1898.”
2 Governor may authorise sale of land.
The Governor may, by notice in the Gazette, authorise the Clyde Town Board to sell the land described in Part I. of the Schedule hereto, in such areas and on such terms as he thinks fit, and he may execute on behalf of Her Majesty whatever transfer or other assurance is necessary.
3 Proceeds of sale to be placed to a trust account for the purchase of other land.
The proceeds of the sale shall, without deduction, be placed to a trust account in the name of the Minister of Lands and of the said Board in the Bank of New Zealand at Napier, and shall only be used in the purchase of the whole or a portion of the land described in Part II. of the Schedule hereto, or of such other land as the Governor thinks fit.
4 Such lands to be held in trust for a public domain.
The lands so purchased shall be conveyed to Her Majesty, and thereupon the management thereof shall vest in the said Board in trust for a public domain, upon the same trusts and subject in all respects to the same rights as exist at the present time in Her Majesty and the said Board respectively in the land described in Part I. of the Schedule hereto.
Schedule Exchange of Clyde Domain
Part I.—All that parcel of land in the Hawke’s Bay Land District, containing by admeasurement 7 acres 1 rood, more or less, being Section No. 12, Class II., Suburban, Township of Clyde. Bounded towards the north by Lucknow Street; towards the north-east by Lahore Street; towards the south-east by Section No. 11; and towards the south-west by a public road: excepting the road which intersects the above-described area.
Part II.—All that parcel of land in the Hawke’s Bay Land District, containing by admeasurement 8 acres, more or less, being Sections Nos. 4, 5, 10, and 11, Class I., Suburban, Township of Clyde. Bounded towards the north-west by Sections Nos. 9 and 6; towards the north-east by Cabool Street; towards the south-east by Clive Road; and towards the south-west by Campbell Street.
