An Act to amend “The St. Albans Public Library Transfer Act, 1893.”
Preamble.
WHEREAS by “The St. Albans Public Library Transfer Act, 1893”
(hereinafter termed “the said Act”
), it was enacted, inter alia, that it should be lawful for the Honourable John Thomas Peacock, William Hannibal Lane, and John Leaf Wilson, or other the continuing or surviving trustees for the time being in whom the land and premises described in the Schedule thereto were vested, to convey the same to Charles Robert Blakiston, of Christchurch, Esquire, and John Aldred, of St. Albans, Wesleyan minister, or other the trustees for the time being of the Knightstown Library therein mentioned, upon the trusts therein declared with respect thereto: And whereas the said John Aldred died on or about the fourteenth day of January, one thousand eight hundred and ninety-four: And whereas by conveyance dated the sixteenth day of February, one thousand eight hundred and ninety-four, and registered in the Canterbury Deeds Registry Office at Christchurch as No. 87410, the said land and premises were conveyed to and became vested in the said Charles Robert Blakiston as the sole surviving trustee of the said Knightstown Library upon the trusts aforesaid: And whereas the said Charles Robert Blakiston died on or about the first day of September, one thousand eight hundred and ninety-eight: And whereas it is desirable that a new trustee should be appointed in the place of the said Charles Robert Blakiston, and that further provision as hereinafter set forth should be made:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The St. Albans Public Library Transfer Act 1893 Amendment Act, 1898.”
2 Governor may appoint new trustees.
The Governor may appoint one or more trustees of the Knightstown Library in place of the said Charles Robert Blakiston, and thereupon the said land and premises shall vest in the said trustee or trustees subject to the trusts aforesaid.
3 Power to trustees to deal with land and premises.
It shall be lawful for the trustee or trustees for the time being in whom the land and premises described in the Schedule to the said Act are vested to sell and dispose of the same, either together or in parcels, and either by public auction or private contract, and upon such terms and subject to such conditions and in such manner in all respects as he or they may think fit, with power to buy in, or rescind, or vary any contract for sale, and to resell without being responsible for loss, and to execute all necessary deeds and other assurances in favour of the purchaser or purchasers thereof or as he or they direct.
4 Proceeds of sale, how disposed of.
The proceeds of such sale as hereinbefore mentioned shall be devoted to the following purposes: First, to the payment of all the expenses of and incidental to the said sale and all attempted sales of the said land and premises; and, secondly, in making such alterations, additions, or other improvements to the said Knightstown Library premises as the trustee or trustees for the time being of the Knightstown Library shall think proper, and in providing books and other literature for such library: Provided that not less than three-fourths of the net proceeds shall be devoted to making such alterations, additions, or other improvements as aforesaid.
