An Act to authorise the Sale by the Thames Harbour Board of a Small Portion of its Foreshore Endowment at Thames to the Thames Borough Council for the Purposes of a Recreation-ground and a Road.
Preamble.
WHEREAS the land described in the Schedule hereto is, inter alia, vested in the Thames Harbour Board, in pursuance and by virtue of “The Thames Harbour Board Act, 1878,”
in trust, for the improvement and maintenance of the harbour of the Port of Thames: And whereas the taking by Proclamation of certain other parts of the said Board’s endowment at Thames for the purpose of the Thames-Waikato Railway severed the land described in the Schedule hereto from the other parts of the said Board’s endowments: And whereas, the land so severed being in close proximity to the Thames Railway-station, the Council of the Borough of Thames is desirous of acquiring such piece of land for the purposes of a road and recreation ground, and thereby improving and ornamenting the approach to the said railway-station;
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Thames Harbour Board Empowering Act, 1899.”
2 Power to Harbour Board to sell land to borough.
It shall be lawful for the Thames Harbour Board, and it is hereby authorised and empowered, to sell, convey, transfer, and assure, at suck price or prices and upon such terms and conditions as it shall see fit, the land described in the Schedule hereto to the Corporation of the Mayor, Councillors, and Burgesses of the Borough of Thames for the purpose of a recreation-ground and a road.
3 Harbour Board empowered to execute all necessary deeds of transfer.
It shall be lawful for the Thames Harbour Board, and it is hereby authorised and empowered, to do and execute all such acts, deeds, transfers, matters, and things necessary or requisite for the purpose of vesting in fee-simple the said piece or parcel of land described in the Schedule hereto in the said Corporation of the Mayor, Councillors, and Burgesses of the Borough of Thames, in such manner and form as the said Corporation may desire, but so that one portion thereof shall be for a road and the remaining portion thereof for a recreation-ground.
Schedule
All that piece or parcel of land containing by admeasurement 2 roods 13 perches, more or less, situated in Block IV., Thames Survey District, in the Land District of Auckland, and which is commonly known as a portion of the “Thames. Foreshore,”
and comprising parts of the following blocks of land: Moanataiari No. 8a, Moanataiari No. 8b, Moanataiari No, 9, and Kauaeranga B No. 13. Bounded towards the north-east by original high-water mark of the Firth of Thames, from Williamson Street, Grahamstown, to Albert Street, Grahamstown; towards the south-east by Albert Street, 104 links and 91 links respectively; and towards the south-west by a public road, 316 links and 331·4 links respectively; and towards the north-west by Williamson Street, 20·9 links.
