An Act to empower the Lyttelton Borough Council to erect Gasworks.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Lyttelton Borough Council Empowering Act, 1901.”
2 Interpretation.
This Act shall be read subject to the interpretations respectively contained in “The Municipal Corporations Act, 1900”
(hereinafter called “the said Act”
).
3 Interpretation of the words “the undertaking.”
In this Act, if not inconsistent with the context, “the undertaking”
means the undertaking of the Lyttelton Gas, Coal, and Coke Company (Limited), authorised by “The Lyttelton Gas Act, 1874,”
and includes all the works, machinery, and plant thereof, and the lands whereon the gasworks and buildings used in connection with the same are erected, and the business carried on by the said company as a going concern, and all the rights, powers, and privileges conferred upon the said company by the said “Lyttelton Gas Act, 1874.”
4 Borough of Lyttelton authorised to acquire the undertaking.
It shall be lawful for the Borough Council of the Borough of Lyttelton, on behalf of the Corporation of the said borough, to acquire and take the undertaking in the manner provided by “The Public Works Act, 1894,”
as if the undertaking were land taken by the said Borough Council for a public work; and all the provisions of the following sections of “The Public Works Act, 1894,”
shall apply, mutatis mutandis, that is to say: Subsection three of section eighteen, except the words “together with the aforesaid map in duplicate,”
in paragraph (a) thereof; sections nineteen, twenty-one, twenty-six, thirty-four to eighty-two inclusive, and eighty-six, the words “the undertaking,”
as hereinbefore defined, being substituted for the word “land”
wherever it occurs in the said sections.
5 Notice to acquire the undertaking to be publicly notified
Before laying before the Governor a memorial, as provided by subsection three of section eighteen of “The Public Works Act, 1894,”
the said Borough Council shall cause a notice to be gazetted, and be twice publicly notified, stating its intention to acquire the undertaking.
6 Disposal of surplus profits.
It shall be lawful for the Council from time to time to transfer to the general account of the Borough of Lyttelton any surplus remaining to the credit of the separate account which the Council would be obliged by law to keep, showing the moneys accruing from gasworks or electric-light works: Provided always that no moneys shall be so transferred till due provision is first made for all sums with which the separate account is by law chargeable.
