An Act to provide for the Vesting in the Trustees of the Wesleyan Methodist Connection in the Provincial District of Canterbury of a certain Reserve, being Part of the Town Reserves of Christchurch.
Preamble.
WHEREAS the land described in the Schedule hereto was conveyed, by deed dated the nineteenth day of December, one thousand eight hundred and sixty-one, No. 4765, by the Superintendent of the Province of Canterbury, to the Reverend James Buller in trust as a site for a place of worship for the use of ministers of the Wesleyan Methodist Connection in the Province of Canterbury, and also for a school and ministers’ residence for the use of such members, with a proviso that if the said land should cease to be occupied as aforesaid the said land should revert to the Superintendent for the time being of the said Province of Canterbury; And whereas the said land is not required for the particular purposes mentioned in the said deed, although it has since the grant thereof been used as a parsonage for the benefit of the said Wesleyan Methodist Connection: And whereas it is desirable that the said land should be vested in the trustees hereinafter mentioned free from any restriction or reservation:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Wesleyan Church Reserve Vesting Act, 1901.”
2 Land not liable to revert to His Most Gracious Majesty the King.
The trustees or other persons in whom the said land is now vested shall hold the same upon the trusts set forth in the Wesleyan Model Deed of New Zealand, one thousand eight hundred and eightyseven, mentioned in section three of “The Wesleyan Methodist Church Property Trust Act, 1887,”
and upon and subject to no other trusts or provisions whatever, free from the proviso in the said deed contained, and the liability of the said land to revert to His Most Gracious Majesty the King as in such proviso is mentioned or indicated.
Schedule
All that parcel of land in the Land District of Canterbury, situate in the City of Christchurch, containing by ad measurement 2 acres 3 roods 28 perches, more or less, being part of the Town Reserves of Christchurch. Bounded on the north by Lot 11 of the said reserves, on the south and east by the Town Belt, and on the west by Lot 156 of the said reserves.
