An Act to validate the Election and Appointment of the Rotorua Town Council, and the Acts and Proceedings thereof, and to extend the Boundaries of the Town.
Preamble.
WHEREAS by section two of “The Rotorua Town Council Act, 1900,”
it was declared that, from and after a date to be fixed by the Governor in Council, the inhabitants of the Town of Rotorua should be a body corporate, and be capable of acting by its Council: And whereas by Order in Council dated the sixth day of July, one thousand nine hundred and one, the said sixth day of July, one thousand nine hundred and one, was fixed as the date on which the inhabitants of the Town of Rotorua should be a body corporate, as provided by the hereinbefore-recited section: And whereas prior to the making of such Order in Council—namely, on the twentieth day of December, one thousand nine hundred—an election of three members of the Town Council was held, and on the same day four members of the Council were nominated by the Governor in Council, which said seven members, acting as the Town Council intended to be constituted under the said Act, have bonâ fide performed certain duties and done certain acts which it is expedient should be validated:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Rotorua Town Council Validation and Extension Act, 1901.”
2 Validation of proceedings.
The election and appointment respectively of the members of the Council as aforesaid are hereby declared to be as valid as if the same had been done after the making of the hereinbefore-recited Order in Council, and no act or proceeding of the said Council prior to the passing of this Act shall be questioned on the ground only of the invalidity of such election or appointment.
3 Extended boundaries of Town of Rotorua.
The boundaries of the Town of Rotorua are hereby extended to include the following additional area, namely,—
All that area, containing one thousand five hundred and seventy acres, more or less, bounded towards the north and east by the area constituted under “The Rotorua Town Council Act, 1900”
; towards the south by the southerly boundary-line of Sections sixty-five, fifty-nine, fifty-eight, fifty-five, and fifty-four of the Suburbs of Rotorua; and towards the west by the westerly boundary-line of Sections fifty-four, fifty-three, and fifty-two, and by the Utuhina Stream.
