An Act to provide for the Readjustment of the Boundaries of the Road Districts within the Egmont County and other Adjoining Counties.
Preamble.
WHEREAS by “The Egmont County Act, 1901”
(hereinafter called “the County Act”
), the Egmont County was duly constituted and its boundaries were defined in manner not in accordance with the provisions of “The Counties Act, 1886”
(hereinafter referred to as “the said Act”
), as being made to consist of parts instead of entire road districts: And whereas the Taranaki County Council and the Waimate Road Board respectively have expended certain moneys on works in the Egmont County, and doubts have arisen as to the legality of such expenditure, and as to the right of the Taranaki County Council and Waimate Road Board respectively to recover from the Egmont County the amounts paid by them, the said Taranaki County Council and Waimate Road Board respectively, for the said works: And whereas, for the purpose of giving effect to the County Act and also of enabling the Taranaki County Council and Waimate Road Board respectively to recover the moneys expended by such last-named Council and Board respectively on the said works, it is deemed expedient to readjust the boundaries of the road districts hereinafter mentioned and to remove the doubts hereinbefore mentioned:
Be it therefore enacted by the Greneral Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Egmont County Districts Adjustment Act, 1902.”
2 Parihaka Road District.
So much of the Parihaka Road District as lies within the boundaries of the Egmont County is hereby constituted a new road district within the last-named county, by the name of the Parihaka Road District.
3 Land included in Parihaka Riding.
So much of the former Parihaka Road District of the Taranaki County not included in the Egmont County is hereby merged in the Taranaki County, and shall be an outlying district thereof and form part of the Parihaka Riding of the last-named county.
4 Land included in Egmont County.
So much of the Waimate Road District formerly within the Hawera County but now included in the Egmont County is hereby merged in the Egmont County, and shall form an outlying district thereof.
5 New road districts.
So much of the former Waimate Road District as lies within the Hawera County and so much of the former Parihaka Road District as lies within the Egmont County shall be deemed to be respectively road districts whose boundaries have been altered by the formation of new districts under section four of “The Road Boards Act, 1882,”
to which the provisions of section thirteen of the last-named Act shall be applicable, with this exception: that it shall be optional, and not imperative, with the Egmont County Council and Hawera County Council respectively to dissolve the Boards of such districts respectively as provided in the said section thirteen
6 Application of provisions of former Acts.
All provisions of “The Road Boards Act, 1882,”
and of every other Act relating thereto or amending the same, shall apply in respect of and to the new district mentioned in section two hereof as if such district had been constituted by the Egmont County on petition under section four of “The Road Boards Act, 1882.”
7 Provision as to moneys expended prior to passing of this Act.
All moneys which shall before the passing of this Act have been paid or expended by the Taranaki County Council and Waimate Road Board respectively for or on account of the works hereinbefore mentioned shall be deemed to have been expended by the last-named Council and Board respectively under a contract between the said last-named Council and Board respectively and the Egmont County Council; and all the provisions of “The Counties Act, 1886,”
relating to such respective contracts shall be deemed to have been duly complied with; and all moneys paid or expended by the Taranaki County Council and Waimate Road Board respectively as aforesaid may be recovered by such last-named Council and Board respectively from the Egmont County Council in the manner provided by “The Counties Act, 1886.”
