An Act to change the Purpose of a Reserve in the Borough of Balclutha, to validate Leases thereof, and to empower the Council of the said Borough to sell a Town Hall Site Reserve.

Preamble.

WHEREAS the land described in the First Schedule hereto, being then vested in the Clutha Agricultural and Pastoral Society, was by an Order in Council dated the eleventh day of June, one thousand eight hundred and ninety-four, exchanged for a similar area of recreation reserve then vested in the Corporation of the Mayor, Councillors, and Burgesses of the Borough of Balclutha: And whereas it is expedient that the purpose of the said reserve should be changed from a recreation to an endowment reserve for the said Corporation: And whereas the land described in the Second Schedule hereto is vested in the said Corporation in trust for a site for a Town Hall, but it is desirable that the said Corporation should be empowered to sell the said land and purchase a site in a more convenient position in the borough:

Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title.

The Short Title of this Act is “The Balclutha Reserves and Empowering Act, 1902.”

2 Purpose of reserve changed.

The land described in the First Schedule hereto is hereby changed to an endowment reserve.

3 Validating leases.

All leases of any of the sections of land enumerated in the First Schedule heretofore granted by the said Corporation in compliance with the requirements of “The Municipal Corporations Act, 1900,” are hereby declared as valid as if the said reserve had then been an endowment reserve.

4 Power to sell reserve.

The land described in the Second Schedule hereto may be sold by the said Corporation, and the whole of the proceeds of such sale applied in or towards the purchase of another Town Hall site in the said borough.

Sections 1, 2, 3, 4, 15, 16, 17, 18, 19, and 20, Block VII., Town of Balclutha, containing 2 acres 2 roods, more or less.

SECOND SCHEDULE

Section 15, Block VI., Town of Balclutha, containing 1 rood 1 perch.
