WHEREAS under and by virtue of the provisions contained in the last paragraph of section fifty-four of “The Canterbury College and Canterbury Agricultural College Act, 1896,” His Honour Mr. Justice Denniston, a Judge of the Supreme Court of New Zealand, made an award, dated the twenty-eighth day of June, one thousand eight hundred and ninety-seven, deciding that the sum of six thousand two hundred and fifty pounds, with interest at the rate of five per centum per annum from the said twenty-eighth day of June, one thousand eight hundred and ninety-seven, was payable by the College to the Board of Governors of the Canterbury Agricultural College: And whereas by “The Canterbury College Powers Act, 1898,” section eight, the Board of Governors of the said College is empowered to borrow money to pay to the Board of Governors of the Canterbury Agricultural College the said sum of six thousand two hundred and fifty pounds: And whereas the Board is desirous of paying the said sum either out of capital moneys or income of the said College which may from time to time be in the hands or at the disposal of the said Board, or as may seem best to the said Board: And whereas the said Board has from time to time applied capital and income moneys of the said College in partial discharge of the obligations of the College under the said award: And whereas doubts have arisen as to whether the said Board had or has power to pay the said sum out of such capital or income, and it is desirable to give the Board such power and to remove such doubts:
