An Act to provide for vesting the Huirangi Institute Trust Property in the Huirangi Domain Board and constituting a Common Fund.
Preamble.
WHEREAS sections numbered 138, 139, 140, 141, 142, 152, 153, 154, 155, 156, 166, 167, 168, 169, 170, 171, 172, 173, 174, and 175, in the Township of Huirangi, in the Taranaki County, Taranaki Provincial District, were reserved for public recreation by Gazette notice on the seventeenth day of May, one thousand eight hundred and seventy-eight: And whereas the Governor’s powers under “The Domains Act, 1860,”
were delegated to the Huirangi Domain Board by Order in Council dated the fourth day of November, one thousand eight hundred and seventy-nine: And whereas the Huirangi Institute was incorporated under “The Public Libraries Powers Act, 1875,”
and “The Public Libraries Subsidies Act, 1877,”
for the purpose of providing a library and public hall: And whereas the Trustees have purchased section numbered 80, in the Township of Huirangi, and have established thereon a public hall and library: And whereas the Trustees of the said institute have agreed to vest the land and property held by them in the Domain Board, and the Domain Board has agreed to accept the trust and hold the said land and property for public purposes: And whereas it is deemed by both bodies desirable that the two institutions should be united and the funds from both dealt with by the Domain Board for the mutual benefit of both trusts, and a common fund established:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Huirangi Domain and Huirangi Institute Empowering Act, 1903.”
2 Huirangi Institute property to vest in Huirangi Domain Board.
Section numbered 80 on the plan of the Huirangi Township, now vested in the Huirangi Institute Trustees, shall, on the passing of this Act, become vested in the Huirangi Domain Board, together with all buildings thereon and all property whatsoever held by the said Institute Trustees.
3 Revenue, how administered.
The Huirangi Domain Board shall thereupon have full power to deal with all revenue derived from the said Institute and all revenue derived from the Domain, and shall make thereof a joint fund, which may be dealt with by the Domain Board for the administration of the Domain and the Institute.
