An Act to enable the Mayor, Councillors, and Burgesses of the Borough of New Plymouth and the Hospital and Charitable Aid Board for the District of Taranaki to exchange certain Lands.
Preamble.
WHEREAS the pieces of land hereinafter described in the Schedule A are vested in the Mayor, Councillors, and Burgesses of the Borough of New Plymouth (hereinafter called “the Borough Council”
) as a reserve and endowment for the improvement and benefit of the Town of New Plymouth: And whereas the piece of land hereinafter firstly described in the Schedule B is vested in the Hospital and Charitable Aid Board for the District of Taranaki (hereinafter styled “the Hospital Board”
) as a site for an Old Men’s Home: And whereas the piece of land firstly described in the Schedule B has been found unsuitable for the purposes for which it was intended, and an Old People’s Home has been built on land leased in perpetuity by the Hospital Board, adjoining the lands in Schedule A: And whereas the pieces of land in Schedule A have for some years past been enclosed with and form part of the New Plymouth Hospital grounds, and by far the greater part has been laid out as gardens, which are chiefly used by the patients of the Hospital and the inmates of the Old People’s Home: And whereas the piece of land secondly described in Schedule B was acquired in the year one thousand nine hundred and one, and is now vested in the Hospital Board, subject to certain rights of way over a portion of same, but is not subject to any particular trust: And whereas the pieces of land in Schedule A and the pieces of land firstly and secondly described in the Schedule B are of the same value, and both the Borough Council and the Hospital Board are desirous that an exchange should be made:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The New Plymouth Borough and Taranaki Hospital Exchange Act, 1903.”
2 Exchange of lands in Schedules A and B.
Immediately on the passing of this Act the land described in the Schedule A shall, without any conveyance or other assurance, vest in the Hospital and Charitable Aid Board for the District of Taranaki, freed from the existing trust, and be held in future as a site for an Old Men’s Home; and the land firstly and secondly described in the Schedule B shall, without any conveyance or other assurance, vest in the Mayor, Councillors, and Burgesses of the Borough of New Plymouth, freed from the existing trust as regards the land firstly described in Schedule B, but subject to the existing rights of way as regards the lands secondly described in the Schedule B, and be held in future as a reserve and endowment for the improvement and benefit of the Town of New Plymouth.
3 District Land Registrar to cancel existing certificates and grant fresh ones.
The District Land Registrar of the District of Taranaki shall, upon the application of the Hospital Board and the Borough Council, cancel the respective certificates of title of the land described in the Schedules A and B, and without charge issue fresh certificates of title for the exchanged sections to the Hospital and Charitable Aid Board for the District of Taranaki and the Mayor, Councillors, and Burgesses of the Borough of New Plymouth respectively; and the certificate of title so issued to the Hospital and Charitable Aid Board for the District of Taranaki shall state that the land is vested as a site for an Old Men’s Home, and the certificates of title so issued to the Mayor, Councillors, and Burgesses of the Borough of New Plymouth in like manner shall state that the land is vested as a reserve and endowment for the improvement and benefit of the Town of New Plymouth.
SCHEDULES
Schedule A
All that area in the Taranaki Land District, situate in the Town of New Plymouth, containing by admeasurement 1 acre 2 roods 5 perches, more or less, being Sections Nos. 404, 405, 406, 407, 408, and 409. Bounded towards the north-west by Fulford Street; towards the north-east by Dawson Street; towards the south-east by Sections Nos. 434, 433, 432, and Reserve H; and towards the south-west by Section No. 403.
Schedule B
Firstly, all that area in the Taranaki Land District, containing by admeasurement 1 acre 2 roods 5 perches, more or less, being Allotment L of Subdivision G of the New Plymouth Town Belt. Bounded towards the north-east by Mangorei Road, towards the south-east by other part of the said Subdivision G, towards the south-west by the Henui Stream, and towards the north-west of Allotment K of the said Subdivision G, and being the whole of the land described in certificate of title, Vol. xxx., folio 284, together with the messuage and buildings erected and being thereon.
Secondly, all that area in the Taranaki Land District, situate in the Town of New Plymouth, containing by admeasurement 1 rood 3·6 perches, more or less, being Allotments Nos. 1 and 2 of Section No. 792. Bounded towards the north-west by Section No. 780, towards the north-east by Section No. 793, towards the south-east by Downe Street, and towards the south-west by Dawson Street: subject nevertheless to grant of right of way, registered No. 11337, to James Caddy Davies, his heirs and assigns, over Allotment No. 2 of the said Section No. 792.
