An Act to authorise the Sale by the Thames Harbour Board of a Small Portion of its Foreshore Endowment at Thames to the Thames Borough Council for the Purpose of a Recreation-ground.
Preamble.
WHEREAS the land described in the Schedule hereto is, inter alia, vested in the Thames Harbour Board, in pursuance and by virtue of “The Thames Harbour Board Act, 1878,”
in trust for the improvement and maintenance of the harbour of the Port of Thames: And whereas the taking by Proclamation of certain other parts of the said Board’s endowment at Thames for the purpose of the Thames-Waikato Railway severed the land described in the Schedule hereto from the other parts of the said Board’s endowments: And whereas the Council of the Borough of Thames is desirous of acquiring such piece of land for the purpose of a recreation-ground:
BE IT THEREFORE ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Shore Title.
The Short Title of this Act is “The Thames Harbour Board Empowering Act, 1903.”
2 Power of sale.
It shall be lawful for the Thames Harbour Board, and it is hereby authorised and empowered, to sell, convey, transfer, and assure, at such price or prices and upon such terms and conditions as it shall see fit, the land described in the Schedule hereto to the Corporation of the Mayor, Councillors, and Burgesses of the Borough of Thames for the purpose of a recreation-ground; and the proceeds from any such sale shall be paid to the credit of the Sinking Fund Account for the repayment of the Board’s existing loan of ten thousand pounds.
3 Power to execute deed of transfer.
It shall be lawful for the Thames Harbour Board, and it is hereby authorised and empowered, to do and execute all such acts, deeds, transfers, matters, and things necessary or requisite for the purpose of vesting in fee-simple the said piece or parcel of land described in the Schedule hereto in the said Corporation of the Mayor, Councillors, and Burgesses of the Borough of Thames in such manner and form as the said Corporation may desire, but so that the same shall be for a recreation-ground.

All that area in the Auckland Land District, situated in the Borough of Thames, containing by admeasurement 2 acres 3 roods 3·3 perches, more or less. Bounded by a line commencing at a point bearing south 50° 23’ 36″ west, distant 302·27 links from Standard No. 47, in Albert Street, and proceeding thence north-easterly, bearing north 66° 46’ east, 225·82 links; thence south-easterly, bearing south 20° 51’ east, 153·5 links; thence north-easterly, bearing north 69° 3’ 30″ east, 172·8 links, to the south-western boundary-line of Allotment No. 520, Town of Grahamstown; thence south-easterly along the western boundaries of Allotments Nos. 520, 521, 522, 523, 524, 525, and 525a, Town of Grahamstown, 140·56 links, 386·91 links, 22·51 links, and 45·32 links respectively, to the southernmost corner of the last-mentioned allotment; thence north-easterly along the south-eastern boundary of the said Allotment No. 525a, 33·2 links, to the western side of Brown Street; thence southerly along the western side of Brown Street, 295·84 links, to Cochrane Street; thence south-westerly along the northern side of Cochrane Street, 59·12 links, to the Railway Reserve; and thence north-westerly along the north-eastern boundary of the Railway Reserve, 832 links and 223 links respectively, to the place of commencement: as the same is delineated on the plan marked S.G. 51025, deposited in the Head Office, Department of Lands and Survey, at Wellington, in the Wellington Land District, and thereon bordered green
