An Act to enable the School Commissioners for the Taranaki Provincial District to exchange certain Lands with the New Plymouth Borough Council.
Preamble.
WHEREAS the School Commissioners for the Taranaki Provincial District (hereinafter called “the Commissioners”
) are seised of or entitled to the pieces of land described in the First Schedule: And whereas the New Plymouth Borough Council (hereinafter called “the Borough Council”
) are seised of the lands firstly described in the Second Schedule for purposes of recreation: And whereas the pieces of land secondly described in the Second Schedule are a public domain within the meaning of “The Public Domains Act, 1881,”
but all powers conferred by such Act, excepting the powers conferred by sections five and twelve, have been delegated to the New Plymouth Borough Council since the seventh day of September, one thousand eight hundred and ninety-two: And whereas the lands in the First and Second Schedules are of about equal value: And whereas the Commissioners and the Council are mutually desirous, and it is for the public benefit, that an exchange should be made of the lands described in the First and Second Schedules:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Taranaki School Commissioners and Borough Exchange Act, 1903.”
2 Interpretation.
In this Act the expression—
“The Commissioners” means the School Commissioners of the Taranaki Provincial District:
“The Borough” means the Mayor, Councillors, and Burgesses of the Borough of New Plymouth.
3 Exchange of lands in First and Second Schedules.
Immediately on the passing of this Act the lands described in the First Schedule shall, subject to any existing leases affecting the same, and without any conveyance or other assurance, vest in the borough, and be held in future by the borough in trust for recreation purposes; and the lands described in the Second Schedule shall, without any conveyance or other assurance, vest in the Commissioners, freed from any existing trusts.
4 Fresh certificates of title to be issued, &c.
The District Land Registrar of the District of Taranaki shall, upon the application of the Commissioners and the Council of the borough, cancel any existing certificates of title, and, without charge, issue certificates of title for the lands in the First and Second Schedules to the borough and the Commissioners respectively, in accordance with the provisions of the last section, notwithstanding that part of the land is not under “The Land Transfer Act, 1885,”
and part may at the passing of this Act have been legally Crown lands.
5 Borough may expend moneys in obtaining surrenders of existing leases.
The Council of the borough may expend moneys out of the District Fund in obtaining the surrender of any existing leases affecting the lands so vested in them under this Act.
SCHEDULES
FIRST SCHEDULE
All that parcel of land in the Town of New Plymouth, containing by admeasurement 1 acre 2 roods 8 perches, more or less, being Sections Nos. 332, 333, 334, 358, 359, and 360: bounded towards the north-west by Vivian Street; towards the north-east by Sections Nos. 335 and 361; towards the south-east by Fulford Street; and towards the south-west by Cutfield Road.
Also all that parcel of land in the Town of New Plymouth, containing by admeasurement 4 acres 21 perches, more or less, being Sections Nos. 384, 385, 386, 387, 388, 389, 390, 391, 410, 411, 412, 413, 414, 415, 416, and 417: bounded towards the north-west by Fulford Street; towards the north-east by Morley Street; towards the south-east by Bulteel Street; and towards the south-west by Cutfield Road.
Also all that parcel of land in the Town of New Plymouth, containing by admeasurement 4 acres 21 perches, more or less, being Sections Nos. 436, 437, 438, 439, 440, 441, 442, 443, 462, 463, 464, 465, 466, 467, 468, and 469: bounded towards the north-west by Bulteel Street; towards the north-east by Morley Street; towards the south-east by Downe Street; and towards the south-west by Cutfield Road.
Also all that parcel of land in the Town of New Plymouth, containing by admeasurement 9 acres 26 perches, more or less, being Section T, Town Belt: bounded towards the north-west by Gladstone Road; towards the north-east by Cutfield Road; towards the south-east by Wallace Place; and towards the south-west by Belt Road.
SECOND SCHEDULE
Firstly, all that parcel of land in the Town of New Plymouth, containing by admeasurement 2 roods 2 perches, more or less, being Sections Nos. 998 and 999: bounded towards the north-west by Lemon Street; towards the north-east by Section No. 1000; towards the south-east by Sections Nos. 1015 and 1014; and towards the south-west by Liardet Street.
Secondly, all that parcel of land in the Town of New Plymouth, containing by admeasurement 3 acres 2 roods 20 perches, more or less, being Sections Nos. 1000, 1001, 1002, 1003, 1004, 1005, 1014, 1015, 1016, 1017, 1018, 1019, 1020, and 1021: bounded towards the north-west by Lemon Street; towards the north-east by Sections Nos. 1006 and 1022; towards the south-east by Pendarves Street; towards the south-west by Liardet Street; again towards the north-west by Sections Nos. 998 and 999; and again towards the south-west by the said Section No. 999.
