An Act to enable the South Canterbury Hospital and Charitable Aid Board to sell a Certain Allotment or Parcel of Land now vested in it, and to apply the Proceeds of such Sale in or towards the Erection of an Infectious-diseases Hospital, and the Fixtures, Fencing, and Improvements in connection therewith.

Preamble

WHEREAS the land described in the Schedule hereto became vested in the said Board for the purposes for which it was constituted by virtue of The Hospitals and Charitable Institutions Act 1885 Amendment Act 1886, under certificate of title, Volume 158, folio 19: And whereas the said Board has no further use for the said land for the purpose for which it was vested in the said Board: And whereas it is expedient that the said land should be sold, and the proceeds thereof expended in or towards the erection of an infectious-diseases hospital, and the fixtures, fencing, and improvements in connection therewith:

BE IT THEREFORE ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title

The Short Title of this Act is The South Canterbury Hospital and Charitable Aid Board Empowering Act 1904.

2 Board may sell lands described in Schedule

It shall be lawful for the said Board, whenever it shall think fit, to sell and dispose of by public auction or public tender, either together or in lots, all or any part of the said allotment or parcel of land more particularly mentioned and described in the said Schedule to this Act; and, in case of failure to sell and dispose of such allotment or parcel of land by public auction or public tender as aforesaid, to sell and dispose of the same by private contract in one or more lots.

3 Board may execute transfers of such lands

It shall also be lawful for the Board to make and execute under its common seal a transfer or transfers in the usual form to the purchaser or purchasers of the whole or any part or parts of the land sold under this Act, and every such transfer shall be deemed to convey an estate in fee-simple free from encumbrances.

4 Application of proceeds

The money to arise from every such sale shall be applied first in payment of the expenses attending the same, and then in the manner following, that is to say: In or towards the erection of an infectious diseases hospital, and the fixtures, fencing, and improvements in connection therewith.

Schedule

ALL that area in the Canterbury Land District, containing by admeasurement 2 acres 2 roods 11 perches, more or less, being Reserve No 204 (in red), Town of Timaru. Bounded towards the north by North Street; towards the east by Rose Street; towards the south by Heaton Street; and towards the west by Town Belt.
