AN ACT to authorise the Exchange of certain Lands.
Preamble.
WHEREAS the piece of land described in the First Schedule hereto is a gaol reserve: And whereas the piece of land described in the Second Schedule hereto is vested in the Crown, and is used in conjunction with the land described in the First Schedule as a gaol-site: And whereas the land described in the Third Schedule is vested in the Education Board of the District of Nelson: And whereas it has been arranged to exchange the lands described in the First and Second Schedules for the land described in the Third Schedule:
BE IT THEREFORE ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Nelson Town School Site Exchange Act, 1904.”
2 Vesting land in His Majesty the King.
The land described in the Third Schedule hereto is hereby vested in His Majesty the King.
3 Vesting land in the Education Board of the District of Nelson.
The lands described in the First and Second Schedules hereto are hereby vested in the Education Board of the District of Nelson for the purpose of a public school.
4 Empowering District Land Registrar to issue certificates of title
The District Land Registrar of the District of Nelson is hereby empowered and directed to issue Land Transfer certificates of title for the lands in question to His Majesty the King and the Education Board of the District of Nelson respectively.
SCHEDULES
FIRST SCHEDULE
All that piece of land in the Nelson Land District, situated in the City of Nelson, containing 2 roods 18 2/10perches, more or less, being a gaol reserve. Bounded towards the north by Shelbourne Street, 342 links; towards the east by part of Section 484, 205·4 links; towards the south by cemetery and public reserve, 70·4 links, and by the Lutheran Church Reserve, 273 links; and towards the west by Shelbourne Street, 143 9 links: be all the aforesaid linkages more or less: as the same is delineated on the plan deposited in the District Lands and Survey Office, Nelson, and thereon coloured yellow.
SECOND SCHEDULE
All that piece of land in the Nelson Land District, situated in the City of Nelson, containing 2 roods 12 6/10 perches, more or less, being part of Section 484 on the plan of the said city. Bounded towards the north by Section 485, 157·7 links and 194T links; towards the east by Collingwood Street, 37·9 links; towards the south and again towards the east by other part of Section 484, 174·2 links and 251·4 links respectively; again towards the south by a public cemetery and a public reserve, 179·8 links; and towards the west by the Gaol Reserve and by Shelbourne Street, 205·4 links and 86·2 links respectively: be all the aforesaid linkages more or less: as the same is delineated on the plan deposited in the District Lands and Survey Office, Nelson, and thereon coloured yellow.
THIRD SCHEDULE
All that piece of land in the Nelson Land District, situated in the City of Nelson, containing 2 acres and 25 perches, more or less, being Sections Nos. 746, 747, and part of Section 748 on the plan of the said city. Bounded towards the north-east by Section 745, 450 links; towards the south-east by St. Vincent Street, 503 links; towards the south-west and north-west and again towards the south-west by other part of the said Section 748, 250 links, 53 links, and 200 links respectively; and again towards the north-west by Sections 1 and 2 of Block F, 450 links: be all the aforesaid linkages more or less: as the same is delineated on the plan deposited in the District Lands and Survey Office, Nelson, and thereon coloured yellow.
