An Act to vest in the Mayor, Councillors, and Burgesses of the Borough of Invercargill, in Trust for an Endowment for the Benefit and Improvement of the New River Harbour, a certain Parcel of Land in the New River Hundred commonly known as “the Sandy Point Domain,”
and also a certain other Parcel of Land in the Invercargill Hundred commonly known as “the Grasmere Domain,”
and to confer upon the Mayor, Councillors, and Burgesses of the Borough of Invercargill aforesaid Powers of Leasing the said Lands, and also, in respect of the Real Estate vested in the said Corporate Body under “The Invercargill Corporation Empowering Act, 1888,”
the Powers of Leasing held by Municipal Corporations, and for other Purposes.
Preamble.
WHEREAS the parcel of land firstly described in the Schedule hereto has been for some time past and still is vested in and held by His Majesty the King in trust for the purpose of recreation, and the same land was brought and still is under the operation of and subject to the provisions of “The Public Domains Act, 1881,”
and His Excellency the Governor has delegated all the powers conferred by the said Act, except the powers under or conferred by sections five and twelve, to the Corporation of the Borough of Invercargill, which should be known as the Sandy Point Domain Board: And whereas the parcel of land secondly described in the said Schedule has been and still is vested in and held by His Majesty the King in trust for the purpose of recreation, and the same land was brought and still is under the operation of and subject to the provisions of “The Public Domains Act, 1881,”
and His Excellency the Governor has delegated all the powers conferred by the said Act, except the powers under or conferred by sections five and twelve, to the Invercargill Borough Council, which should be known as the Grasmere Domain Board: And whereas the said parcels of land have been found unsuitable for the purpose of recreation for which they are now held: And whereas it is expedient to vest the said parcels of land in the Corporation in trust for an endowment for the benefit and improvement of the New River Harbour, and to confer certain powers of leasing upon the Corporation, and to make certain other provisions relating to the Corporation and Council in manner hereinafter expressed and set forth:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Sandy Point and Grasmere Domains Vesting Act, 1906.”
2 Interpretation.
In this Act, if not inconsistent with the context,—
“Corporation” means the Mayor, Councillors, and Burgesses of the Borough of Invercargill:
“Council” means the Council of the said borough.
3 Parcels of land described in Schedule to vest in Corporation in trust as an endowment for the benefit and improvement of the New River Harbour.
The parcels of land described in the Schedule hereto are hereby vested in the Corporation in trust for an endowment for the benefit and improvement of the New River Harbour.
4 Corporation to have powers of leasing same parcels of land.
The Corporation shall have in respect of the said parcels of land all the powers of leasing conferred by “The Municipal Corporations Act, 1900,”
upon it as a Municipal Corporation constituted by the said Act, subject to the conditions and exceptions in the last-named Act expressed, which powers shall be exercisable by the Council in the name and on behalf of the Corporation.
5 Corporation to have same powers of leasing real estate vested in it under “The Invercargill Corporation Empowering Act, 1888,”
that Municipal Corporations have.
Section nine of “The Invercargill Corporation Empowering Act, 1888,”
shall be deemed to have conferred upon the Corporation acting under the said Act the powers of leasing the real estate vested in the Corporation by the said Act which by “The Municipal Corporations Act, 1886,”
are conferred upon Municipal Corporations, and the Corporation acting under the first-named Act shall have in respect of the said real estate the powers of leasing conferred upon Municipal Corporations by “The Municipal Corporations Act, 1900.”
6 Corporation deemed to have been constituted the Harbour Board of the New River Harbour by section 5 of “The Invercargill Corporation Empowering Act, 1888.”
Section five of “The Invercargill Corporation Empowering Act, 1888,”
shall be deemed to have constituted the Council the Harbour Board of the New River Harbour, and the Council is hereby declared to be the Harbour Board of the New River Harbour.
Schedule
All that parcel of land forming a peninsula in the Land District of Southland and in the New River Hundred, comprising 5,600 acres, more or less: bounded on the north by Block XV, New River Hundred, 155 chains or thereby; on the east and south by the New River and the New River Estuary; and on the west by Foveaux Strait: save and excepting from the said area Section No. 82, New River Hundred, and Sections Nos. 1, 2, 3, and 4, Block XXIII, same hundred: excepting also the belt of land lying between the front of said sections and the New River and the New River Estuary.
Also all that other parcel of land in the Southland Land District and in the Invercargill Hundred, containing by admeasurement 53 acres 3 roods 22 perches, more or less, being Section No. 158, Block XV, Invercargill Survey District: bounded towards the north by Sections Nos. 10 and 29 of Block XV, 1068 and 1099 links respectively; towards the east by Section No. 29 of Block XV and a road-line, 1847 and 1552 links respectively; towards the south-east by foreshore reserve, 2245 links; and towards the west by Section No. 34 of Block XV, 3717 links: be all the aforesaid linkages more or less: as the same is delineated on the plan deposited in the office of the Chief Surveyor, Invercargill.
