An Act to alter the Constitution of the Timaru Harbour Board.
Preamble.
WHEREAS it is expedient to alter the constitution of the Timaru Harbour Board, which Boardwas constituted under the provisions of “The Harbours Act, 1878,”
and the special Acts relating to the said Board:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Timaru Harbour Board Amendment Act, 1906.”
2 Interpretation.
In this Act the word “Board”
shall mean the Timaru Harbour Board.
3 Amendment in constitution of Timaru Harbour Board.
Section three of “The Timaru Harbour Act, 1882,”
is hereby amended by inserting the word “thirteen”
in lieu of the word “eleven”
in the third line thereof; by inserting the words “three persons by the ratepayers of the County of Levels”
in lieu of the words “two persons by the ratepayers of Levels Road District”
in the eighth line thereof; and by inserting the words “two persons”
in lieu of the words “one person”
in the fourteenth line of the said section relating to the representation on the said Board of the Makikihi District.
4 Subdivision of County of Levels into separate districts for purposes of the Act.
For the purposes of this Act the County of Levels shall be subdivided into three separate districts, which shall be defined in the following manner:—
The Tengawai and Point Ridings thereof shall constitute the Northern District;
The Seadown and Waimataitai Ridings thereof shall constitute the Central District; and
The Gleniti, Claremont, and Otipua Ridings thereof shall constitute the Southern District.
5 Election of member for each separate district.
Ratepayers rolls to be combined for use at elections.
(1.)
For each of the three separate districts constituted under the preceding section shall be elected one person to represent the said County of Levels on the said Board. For the election of each such person a roll shall, on a requisition of the Chairman of the Council, be made up by the Clerk of the Council by combining the ratepayers rolls in force for the ridings constituting each such district as aforesaid.
Sections 7 and 8 of “The Timaru Harbour Board Act, 1882,”
to apply.

The provisions of sections seven and eight of “The Timaru Harbour Board Act, 1882,”
shall, mutatis mutandis, apply to such elections.
6 Qualification of members of Board.
Any person qualified to be and not incapable of being a member of the Council of the County of Levels shall be eligible for election as a member of the Board for the separate district within the County of Levels constituted under this Act.
7 Constitution of Timaru Harbour Board.
The corporate capacity, rights, or liabilities of the Timaru Harbour Board as now constituted shall not be affected by this Act. The Board shall continue to be constituted of eleven members until the next general election of members thereof, and thereafter shall be constituted of thirteen members.
8 Act to be deemed a special Act within the meaning of “Act to be deemed a special Act within the meaning of “The Harbours Act, 1878.”

This Act shall be deemed to be a special Act within the meaning of “The Harbours Act, 1878,”
and all the provisions of that Act and of “The Timaru Harbour Board Act, 1882,”
shall extend and apply to this Act, except so far as such provisions may be repugnant to or inconsistent with this Act.
