An Act to amend the Taranaki Botanic Garden Act, 1876.

Preamble.

WHEREAS the lands described in the Schedule hereto are, amongst others, vested in the Board constituted under the Taranaki Botanic Garden Act, 1876: And whereas the said lands are detached from the other lands vested in the said Board, and by reason thereof are unsuitable to be used like such other lands for a botanic garden or public recreation-grounds, and have been for many years a source of expense and no profit to the said Board, the powers of leasing in the Taranaki Botanic Garden Act, 1876, for twenty-one years only being found inadequate to attract tenants:

Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title.

This Act may be cited as the Taranaki Botanic Garden Act Amendment Act, 1907.

2 Board’s action to be subject to the Public Bodies’ Powers Act, 1887.

Notwithstanding anything in the Taranaki Botanic Garden Act, 1876, the Board constituted under that Act shall have and may exercise with respect to the land described in the Schedule hereto all the powers of a leasing authority under the Public Bodies’ Powers Act, 1887, and the provisions of that Act shall apply accordingly, although no Order in Council has been made as provided in section four thereof.

Schedule

All those pieces or parcels of land containing by admeasurement 2 roods 2 perches, more or less, being sections numbered 1047 and 1048 on the plan of the Town of New Plymouth.

Also all that piece or parcel of land containing by admeasurement 2 acres 1 rood 10·4 perches, more or less, being parts of sections numbered 1255 and 1256 on the plan of the Town of New Plymouth, and part section marked X on the plan of the Town Belt of New Plymouth: bounded towards the north and east by Brooklands Road, 976·4 links; towards the south by Holdsworthy Road, 438·25 links; and towards the west by the Carrington Road. 1008·65 links.
