Auckland and Manukau Canal Act 1908

An Act to empower the Auckland Harbour Board to acquire Land for the Construction of a Canal connecting the Waitemata with the Manukau Harbour.

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title
  • This Act may be cited as the Auckland and Manukau Canal Act 1908.

2 Power to acquire land
  • It shall be lawful for the Auckland Harbour Board (hereinafter called the Board), for the purpose of constructing a canal connecting the Waitemata Harbour with the Manukau Harbour, from time to time to purchase or to take or otherwise acquire land, either within or without the limits of its jurisdiction, under the Public Works Act 1981, the provisions whereof shall apply in the case of every such taking, purchase, or acquisition.

    A reference to the Public Works Act 1908 (1908 No 160) was repealed, as from 6 October 1928, by section 346 Public Works Act 1928 (1928 No 21). That Act was in turn repealed, as from 1 February 1982, by section 248(1) Public Works Act 1981 (1981 No 35).

3 Compensation
  • Every person having any estate or interest in any land taken or acquired compulsorily under this Act for the purpose of constructing such canal shall be entitled to full compensation for the same from the Board, and the amount payable for such compensation shall, in default of agreement, be claimed, ascertained, and determined within the time and in the manner provided by the Public Works Act 1981.

    A reference to the Public Works Act 1908 (1908 No 160) was repealed, as from 6 October 1928, by section 346 Public Works Act 1928 (1928 No 21). That Act was in turn repealed, as from 1 February 1982, by section 248(1) Public Works Act 1981 (1981 No 35).

4 How payable
  • Compensation payable in respect of any land taken, purchased, or acquired under this Act, and all costs, charges, and expenses that may be incurred or that may arise by reason or in consequence of the exercise of the powers conferred by this Act, shall be paid out of the Harbour Fund Account of the Board.

5 Power to lease
  • Until the land taken, purchased, or acquired in pursuance of this Act is required for the construction of such canal as aforesaid it shall be lawful for the Board to grant leases of the same or any part thereof in the manner prescribed by and subject to the provisions of the various enactments in force from time to time regulating the leasing of lands vested in the Board.
