An Act to constitute the Waimate West County.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Waimate West County Act, 1908.
2 Waimate West County constituted.
(1.)
The Waimate Road District is hereby abolished, and in lieu thereof the Waimate West County is hereby constituted, and shall comprise the Waimate Road District, the area and boundaries of which are more particularly described in the First Schedule hereto. The boundaries of the Hawera County are hereby altered accordingly, and shall be as described in the Second Schedule hereto.
(2.)
The said Waimate Road District shall be deemed to be merged in the Waimate West County hereby constituted.
3 Powers conferred on Waimate West County.
From and after the coming into operation of this Act, and during the existence of the county hereby constituted, no local body or authority other than the County Council shall, within the limits of the said county, be created or exercise any jurisdiction or authority over any roads or over or in relation to any matter or thing in respect of which jurisdiction is conferred upon a County Council under the provisions of the Counties Act, 1908, or otherwise:
Provided that nothing herein shall affect the power of the Governor to proclaim any portion of the said county a borough or town district.
4 Contribution to Eltham Road.
(1.)
So long as the Township of Opunake remains unconnected by a line of railway open for traffic with the present line of railways between New Plymouth and Wellington the Waimate West County Council shall, during the month of October in every year, pay to the Eltham County Council the sum of one hundred pounds.
(2.)
The said sum shall be expended by the Eltham County Council in maintaining in repair that part of the Eltham Road which is within the Kaponga Riding of the Eltham County.
(3.)
If the Waimate West County Council makes default in any such payment, the amount thereof may be recovered in any Court of competent jurisdiction as a debt.
SCHEDULES
FIRST SCHEDULE Boundaries of the Waimate West County
All that area in the Land District of Taranaki bounded by a line commencing at the south-west corner of Section 1, Block V, Waimate Survey District; thence proceeding north along the western boundaries of Blocks V and I, Waimate Survey District, to the south boundary of Section 20, Block I, Waimate Survey District; thence due west to the middle of the Oeo Road opposite to the south-west corner of Section 20, Block I, Waimate Survey District; thence by a line along the middle of the Oeo Road to the southern boundary of Block IX, Kaupokonui Survey District; thence due east along the southern boundaries of Blocks IX, X, and XI, Kaupokonui Survey District, to the middle of the Palmer Road; thence south by a line along the middle of the Palmer Road to the northern boundary-line of Section 147, Block IV, Waimate Survey District; thence by a line due west to the north-east corner of Section 75, Block III, Waimate Survey District; thence by a line in a southerly direction along the eastern boundary-line of Block III, Waimate Survey District, to the Inaha Road; thence west to the middle of the Inaha Road; thence by a line along the middle of the Inaha Road to the sea; and thence westerly by the sea to the place of commencement, the sea being the southern boundary.
SECOND SCHEDULE Altered Boundaries of the Hawera County
All that area in the Taranaki Land District bounded towards the north generally by Eltham County; towards the south-east generally by Patea County; towards the south-west generally by the sea; and towards the west by Waimate West County, as described in the First Schedule hereto: excepting the Borough of Hawera.
