An Act to enable the Borough Council of Whangarei to acquire a Portion of the Whangarei Public Cemetery in order to establish thereon an Abattoir.
Preamble.
WHEREAS under and by virtue of the provisions of the Cemeteries Act, 1882, and its amendments the Whangarei Borough Council is a local authority in whom is vested the control and management of the public cemetery described in the First Schedule hereto: And whereas it has become necessary for the Whangarei Borough Council to establish an abattoir in terms of section five of the Slaughtering and Inspection Act, 1908, and a portion of the said public cemetery has, with the consent and concurrence of the Whangarei Borough Council as trustees of the said public cemetery, been selected as a most suitable place to establish such abattoir, and the same has been surveyed, and is described in the Second Schedule hereto:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Whangarei Abattoir Site Act, 1908.
2 Land described in Second Schedule not to be used as cemetery-site.
It shall be lawful for the Governor upon the passing of this Act, by notification in the Gazette, to declare that all that piece or parcel of land described in the Second Schedule hereto shall, from the date of publication of such notification, be no longer required for the purposes of a public cemetery.
3 Land to be used as abattoir-site.
The Governor may, after the publication of the notification in terms of the preceding section hereof, issue a Crown grant or certificate of title, as the case may require, in fee-simple for the land described in the said Second Schedule to and in favour of the body corporate called “The Mayor, Councillors, and Burgesses of the Borough of Whangarei”
in trust as a site for an abattoir for the said borough.
SCHEDULES
FIRST SCHEDULE
All that area in the Auckland Land District, being Section No. 1 of Block XVI, Purua Survey District, and containing by admeasurement 50 acres, more or less, as the same is more particularly described in Gazette No. 66 of 1883, page 939.
SECOND SCHEDULE
All that area in the Auckland Land District, being Section No. 1a of Block XVI, Purua Survey District, being a portion of Section No. 1 described in the First Schedule hereto, and containing by admeasurement 17 acres 3 roods 24 perches, more or less, bounded as follows: commencing at the south-west corner of original Section No. 1 aforesaid; towards the south-west by the Great North Road, 447·9 links, bearing 341° 57′; towards the north-west by right lines, 968 links, bearing 74°5′ 20″, and 1522 links, bearing 71° 15′ 30″; towards the east and south by the Whangarei High School Endowment called or known by the name of Kioreroa and numbered 3494a, 1121 links, bearing 178° 29′, and 2264 links, bearing 268° 29′ respectively, to the point of commencement: be all the aforesaid linkages more or less.
