Contents
An Act to provide, inter alia, for the Acquirement of a Site for School Buildings for the Gisborne High School.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Gisborne High School Amendment Act, 1909.
2 The principal Act.
The Gisborne High School Act, 1885, is herein referred to as the principal Act.
3 Vesting Allotment No. 184, Town of Gisborne, as a site for a high school.
The reservation of the land described in the First Schedule hereto for primary education purposes is hereby cancelled, and the said land is hereby vested in the Gisborne High School Board for school buildings and premises, school boardinghouses, masters’ residences, and for the purposes set out in section nineteen of the principal Act:
Provided that nothing herein shall affect any contract heretofore entered into concerning or touching the said land, but any such contract shall continue in full force and effect.
4 Vesting certain reserves, the rents and profits of which now belong to the Gisborne High School Board, for high-school purposes.
The lands described in the Second Schedule hereto, now vested in the School Commissioners of the Provincial District of Auckland, but the rents, profits, and income of which are payable to the Gisborne High School Board in terms of the principal Act, are hereby divested from the said School Commissioners and vested in the Gisborne High School Board, for the purposes set out in section nineteen of the principal Act:
Provided that nothing herein shall affect any contract heretofore entered into by the School Commissioners with any person or persons, but any such contract shall for all purposes continue in full force and effect and be deemed to have been entered into by the said Board.
5 Vesting certain lands in the Auckland School Commissioners by way of exchange.
The Governor may, by notice in the Gazette, set apart as an endowment for primary education the lands described in the Third Schedule hereto in exchange for the lands described in the First Schedule, and may grant the same to the School Commissioners of Auckland for the objects and purposes and upon the same trusts for and upon which the lands described in the said First Schedule were held.
6 Section 18 and part of section 24 of principal Act repealed.
Section eighteen of the principal Act is hereby repealed; and the words “not exceeding in the whole the sum of three thousand pounds”
in section twenty-four of the principal Act are also hereby repealed.
7 Provision for completing title in the Gisborne High School Board.
To give effect to and carry out the provisions of this Act the District Land Registrar for the Land Registration District of Poverty Bay is hereby authorised to cancel, call in, and rectify any certificates of title heretofore issued for any of the lands described in the First and Second Schedules hereto, and to issue new certificates of title for the same in the name of the Gisborne High School Board; and the production of a request to that effect under the common seal of the said Board shall be a sufficient authority for the Registrar to do all things necessary to give effect to that request.
