An Act to enable the Roman Catholic Archbishop of Wellington to erect a Boarding-school on certain Land situate in the City of Wellington, and to borrow and raise Money on the Security of the same and of certain other Lands, and to devote the Net Proceeds in or towards the Erection and Upkeep of certain School and other Buildings thereon.
Preamble.
WHEREAS by a Crown grant dated the twenty-first day of February, eighteen hundred and fifty-two, and registered in the Deeds Office at Wellington as Number 102164, certain land described in the First Schedule hereto was vested in the Right Reverend Philip Joseph Viard, then Bishop of the Roman Catholic Church at Wellington, and his successors, in trust for and towards the religious education, industrial training, and instruction in the English language of female children educated therein or maintained thereat: And whereas school buildings and an orphanage for girls were and are duly erected on the said land: And whereas, owing to the growth and expansion of the City of Wellington, the said land is now less suitable than formerly for the purposes of the said trust, and the Archbishop has decided, for the more efficient fulfilment of the same, to utilise other and more suitable land: And whereas by a Crown grant dated the eighteenth day of January, eighteen hundred and fifty-three, and registered in the Deeds Office at Wellington as Number 102163, the lands described in the Second Schedule hereto were duly vested in the said Right Reverend Philip Joseph Viard and his successors, Roman Catholic Bishops of Wellington: And whereas by a deed of conveyance dated the twenty-seventh day of September, eighteen hundred and seventy-five, and registered in the Deeds Office at Wellington as Number 23374, the land described in the Third Schedule hereto was vested in the Right Reverend Francis Redwood, then Bishop of Wellington, in trust for the order of nuns known as the Sisters of Mercy, belonging to or connected with the Roman Catholic Church in the Provincial District of Wellington: And whereas under and by virtue of the Roman Catholic Lands Extension Act, 1890, all the lands hereinbefore and hereinafter mentioned became vested in the Roman Catholic Archbishop of Wellington in trust as aforesaid: And whereas the Archbishop now proposes to erect more suitable school buildings for the purpose of making better provision for education in and throughout the Archdiocese of Wellington: And whereas the Archbishop is also seised in trust of the lands described in the Fourth Schedule hereto, and desires authority to raise money by way of mortgage on the security of these and the other lands hereinbefore mentioned, and to erect and maintain school and other buildings as aforesaid: And whereas the powers requisite to enable the Archbishop to erect a boarding-school on the land described in the First Schedule hereto, to erect an orphanage on the land described in the Third Schedule hereto, to erect school and other buildings on the lands described in the Fourth Schedule hereto, to raise money by way of mortgage on the security of all or any of the lands described in all the Schedules hereto, and to expend the proceeds in the erection and upkeep of school and other buildings as aforesaid, are not attainable otherwise than by legislation:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Roman Catholic Archbishop Empowering Act, 1909.
2 Interpretation.
In the interpretation of this Act the expression “the Archbishop”
shall mean and include the Roman Catholic Archbishop or Bishop of the Archdiocese or Diocese of Wellington for the time being.
3 Archbishop may erect boarding-school and orphanage.
(1.)
It shall be lawful for the Archbishop to erect and maintain a boarding-school for girls on the land described in the First Schedule hereto, and to erect and maintain an orphanage for girls on the land described in the Third Schedule hereto.
(2.)
It shall be lawful for the Archbishop to erect and maintain school buildings, church buildings, and such other buildings as may from time to time be required in the Borough of Carterton on the lands described in the Fourth Schedule hereto.
4 Archbishop may borrow.
For the purpose of erecting and maintaining such buildings as aforesaid it shall be lawful for the Archbishop from time to time to borrow and raise money by way of mortgage on the security of the said lands or any of them, or on the security of any part or parts of them respectively, and on the security of the buildings intended to be erected thereon; and every such mortgage shall contain such covenants, conditions, and powers as may by law be implied, or (not being inconsistent with this Act) as may be agreed upon by and between the Archbishop and the mortgagee or mortgagees, as the case may be:
Provided that, in respect of the land described in the Third Schedule hereto, money raised thereon by way of security shall be applied solely for the purposes of the orphanage to be erected thereon:
Provided also that, in respect of the lands described in the Fourth Schedule hereto, moneys raised thereon shall be applied solely for the purpose of erecting and maintaining buildings within the Borough of Carterton.
SCHEDULES
FIRST SCHEDULE
All that piece or parcel of land, situate in the City of Wellington, containing 1 acre, more or less, being the section numbered 559 on the plan of the said city: bounded towards the north by Hawkestone Street, 200 links; towards the east by section numbered 561 on the said plan, 500 links; towards the south by section numbered 558 on the said plan, 200 links; towards the west by section numbered 557 on the said plan, 507 links: be the same admeasurements and each of them a little more or less: and being the land described in Crown Grant No. 33, and registered at Wellington as No. 102164.
SECOND SCHEDULE
All that piece or parcel of land, situate in the City of Wellington, containing 2 acres, more or less, being the sections numbered 555 and 557 on the plan of the said city: bounded towards the north by Hawkestone Street, 400 links; towards the east by section numbered 559 on the said plan, 507 links; towards the south by sections numbered 556 and 554 on the said plan, 400 links; and towards the west by section numbered 553 on the said plan, 523 links: be the same admeasurements and each of them a little more or less: and being part of the land described in Crown Grant No. 458, and registered at Wellington as No. 102163.
THIRD SCHEDULE
All that piece or parcel of land, situate in the Upper Hutt District, containing 4 acres, more or less, being part of section numbered 119 on the plan of the said district: bounded towards the north by part of the said section, 300 links; towards the east by a public road shown on the said plan, 50 links wide, 1100·66 links; towards the south by other part of the said section, 200 links; towards the east again by other part of the said section, 500 links; towards the south by the Hutt Road, 100 links; and finally towards the west by other part of the said section, 1600·66 links: be the same admeasurements and each of them a little more or less: being part of the land described in Crown grant dated the 6th day of October, 1853, registered in the Deeds Office at Wellington as No. 449, and the whole of the land described in deed of conveyance numbered 23374 and dated the 27th day of September, 1875.
FOURTH SCHEDULE
1.
All that piece or parcel of land, situate in the Borough of Carterton, containing 8 acres 3 roods 12 perches, be the same a little more or less, being the section numbered 26 on the plan of the said borough: bounded towards the north by a public road, High Street, 500 links; towards the east by the section numbered 25 on the plan of the said borough, 1775 links; towards the south by the section numbered 102 on the plan of the said borough, 500 links; and towards the west by the section numbered 27 on the said plan, 1792 links: be the same admeasurements and each of them a little more or less: and being the whole of the land included in deed of conveyance dated the 20th day of September, 1867, and registered in the Deeds Office at Wellington as No. 9780.

All that piece or parcel of land, situate in the Borough of Carterton, containing 19·9 perches, being part of Lot 3 on deposited Plan No. 1393, part of Section 10, Borough of Carterton, and the whole of the land comprised in certificate of title, Vol. clxxvii, folio 27.

All that piece or parcel of land, situate in the Borough of Carterton, containing 1 acre 2 roods 0·7 perch, being Lots 1 and 2 and 12 to 15 on deposited Plan No. 1393, and part of Section 10, Borough of Carterton, and the whole of the land comprised in certificate of title, Vol. cxlii, folio 99.
