WHEREAS by deed dated the twenty-fifth day of January, eighteen hundred and eighty-two, made between Her late Majesty the Queen of the one part and the Mayor, Councillors, and Burgesses of the Borough of Invercargill of the other part, all that parcel of land in the Town of Invercargill, containing seven acres and twenty-three and five-tenths poles, more or less, bounded on the north by the Hospital Reserve, on the east by Leven Street, on the south by the Drill-shed Reserve, and on the west by the Invercargill–Kingston Railway, was vested in the Mayor, Councillors, and Burgesses of the Borough of Invercargill in trust as a site for public gardens for the purposes of recreation and amusement: And whereas the Councils of the Boroughs of Invercargill and South Invercargill are about to construct tramways under the authority of an Order in Council made under the Tramways Act, 1894, and dated the thirtieth day of May, nineteen hundred and eight, known as the Invercargill and Suburban Tramway Order Number 1, and it is expedient to appropriate and set apart as a site for the buildings and works necessary for the said tramways that portion of the said parcel of land described in the Schedule to this Act:
